I don't see anything wrong with them classifying magic as an art form. Plenty of magicians intertwine their works with comedy among other things to make people smile.
technically magic is a form of art and thus free speech it makes sense despite sounding dumb on paper.

I think you guys are overreacting. I think it's important to recognise magic as an art form and allow talented performers to make a career out of it.

Similar to how the Coke formula isn't patented, they just don't want people to learn the formula.

By patenting his magic trick the magician becomes its sole and exclusive performer but in exchange he must reveal how the device or process work. Copyright offer better legal protection than patent, because it's automatic (you don't need to register your trick), the protection last longer and you're not required to expose the ingredients of your trick. Too bad there is almost no case law in regards to copyrighting magic tricks.

are they referring to sleight of hand and stage magic, wicca, voodoo, or the nutjobs that think a geode prevents cancer? the first 4 I could see being art forms, as sleight of hand and stage magic are often referred to as "the art of deception" and wicca and voodoo are deeply rooted in american culture and both involve some pretty intricate rituals e: just read the full text of the bill and it's definitely referring to sleight of hand and stage magic which is generally already considered a performance art by the general public
