• Had a little run-in with the law...

Well me and my 3 friends were just sitting in my car, having a cig, when out of nowhere cops boxed us in. They approached and cop A asked for ID's. We gave them to them with no difficulty. They then asked what we were doing. I told them the truth. You see, I was waiting for my friend Joe to call so I could go there for the night, we had a shroom trip planned. He said he doesn't understand why we were sitting in my car where we were. I tol him it was halfway between our houses and he wasn't home yet, and since I was already out I thought I'd just wait for him to come home. At this point the officer looked as though he was getting mad at me. He kept telling my it just doesnt make sense. He then asked what we were drinking. We all had Arizona iced Teas. I showed him the can and let him smell it, alcohol free. Then he asks if he could search the car. I told him that I was always told in law class to never consent to a search without warrant. After that he said "well look at you tough guy. now that you said that I have the right to search on suspicion." He pulled us all out, frisked us down etc. He made us sit on the car as his buddy started tearing mine apart, throwing all my receipts all over my car. After a while his friend when to his car. He asked one last time "is there anything in your car we should know about?" I was shaking so badly, as I'm already on probation, getting off march 24th. I just looked at him and said "yes, there's pot under the drivers seat" I almost threw up from being so nervous. "how much?" "just a small amount, a little over a gram." "Let me go talk to my buddy..." About 5 minutes (the longest 5 minutes of my life) later he came back started explaining about us ruining our lives then he explains what just happened. He said his friend was finishing up all our tickets and was getting handcuffs to take us all in when I admitted. He said since I owned up to it and was ready to take the fall for my friends, we'll get off with a warning...if I call my mother. I did, we're fine, and now I'm not allowed out of the house for a minimum of two weeks. I just wanted to share this to let you guys know - [b]be careful out there.[/b] I'm now giving up smoking pot until I can get my medical card for my spinal problems, hopefully within a few weeks. derpdepr no you should have said "i do not give you permission to search my car, but i am not going to resist if you choose to. You should know that i WILL let my lawyer know if you search" you got lucky for getting off with a warning (i guess depending on your state law)
Even if you refuse the search he can't just force you to consent to it, go talk to a lawyer and try to get something from them

Sure there is, he conducted an illegal search. According to your story you never consented, they removed you from the vehicle and searched it because you told him that you aren't consenting to it.

An illegal search is still an illegal search. The glove compartment's locked and so's the trunk in the back. I know my rights you're gonna need a warrant for that.
I'd get a lawyer on that.

He won't get anywhere threatening to press charges either since an officer doesn't really need a warrant to search your vehicle. He can search off of reasonable suspicion. They do it all the time on cops and they're on live television. If you decline, they could call a K-9 unit to search around your vehicle too. His suspicious behavior and the way he answered his questions (for example if he appeared to be nervous at the time) is also enough to search the car.

Denying them the search isn't enough to have reasonable suspicion. And no, they cannot call the K-9 unit unless they have actual probable cause to do so. Again, simply denying a search is not enough to do that. They can threaten to call the K-9 unit to scare you and say if you just tell them what you have right then they'll let you off easy because they don't have to waste time with the dogs, but in the end if they do you can sue the shit out of them.

What I am guessing happened is that the cop talked more and more and eventually got the OP to consent to a search. I really doubt the cop searched without consent. Cops are allowed to lie to do their job, and there was likely a few lies thrown in about not being thrown in. Here is some advice. If you're at a dorm and smoking with some friends in your room and the cops knock on the door, don't let them in no matter what, no matter what they say, and escape out the window granted that it is all clear. Don't admit to anything, and don't give in to any compromises. You'll probably face some University discipline, but that is far better than having to go to court and paying large fines.

They'll laugh you out of the court. The officer had reasonable suspicion because of the way he was perched there with a cig and he probably sounded nervous as shit. That's all he needs. They can call a K-9 unit out of whim, trust me. Especially if you threaten them with lawyers and they actually buy it. You can't sue them for having a dog sniff around your car. I don't really like how they don't need shit to bust you, its just how it is.
Cops use lots of scare tactics, you need to stick to your rights and if he says probable cause you say lawyer

If what he said went down the way he said it, then the cop can be brought up on an illegal search

My friend actually had them threaten it, the officer actually went as far as to pretend to call it in, but he clearly didn't actually call anybody, then came back and said that the unit was tied up and he'd let my friend off with a warning.

The police love to fuck around with kids. Generally when you do something dumb (or a misdemeanor, in this case) the cops try to give you a really hard time and scare you straight from doing it again. To drive the point home, they threaten you with jail time (which is what happened in this case, using your positive admittance as a sort of ruse) unless you call the people you fear most. Your parents. Odds are they would have given you tickets, and taken your shrooms, then sent you on your way. But that's just my opinion, it could have been true this time.
wait, did he actually tell the cop he was going to do shrooms? i thought he was just saying that was what he was going to do at his friend's house...

Cops are fucking assholes most of the time, sometimes there's a good cop but mostly they will just try to catch you for the littlest thing. Here in Holland cops need to bring in a certain amount of money through fines, which explains it sort of.
If I was you I wouldn't have told him, unlikely after tearing the car apart he would've gone under the seat
