Garry just posted this on Twitter.

This is the post:

It's not even hosted on Facepunch, why are they poking garry about it?
That thing you got over there that you don't really have because we have it... you should take it down.
That's how I interpret it.
hooray i am the 3rd post in an original thread about a facepunch legendary event
It's a fucking picture of a Wok. A FUCKING WOK ON A WHITE BACKGROUND.
This can't be real. Right?
Oh god, germans.
Just going to force some legal action because of this because they think they are on the right side of the law is just so... GERMAN.
We should post tons and tons of pictures from the site.
This isn't a violation US copyright laws, or EU copyright laws.
But there is a provision of the DMCA that allows for cease-and-desist. Problem is that the owner is German, the content is owned in Germany, and FP is based out of the UK. The image is hosted on a Canadian site.
So there's a bit of a clusterfuck.
As far as the DMCA is concerned if the image is removed now then that's the end of it.
Surely they should be going after asiannoodlehouse.ca for this.

I CBA to look up DMCA and all, what happens if it doesn't get removed?
Surely they should be going after asiannoodlehouse.ca for this.
Also this, they obviously don't know anything about image hosting, otherwise they'd just get asiannoodlehouse.ca to take it down and it'd disappear on FacePunch.
Whats a DMCA again?
Shit reminds me of the righthaven suit a few years back, also over a picture.
Thats a damn fine wok, why would they send a DMCA notice to remove their free advertisement.
It's something they apparently do on a regular basis.

http://www.tutsi.de/marions-kochbuch-wieder-abmahnungen-fuer-tolle-fotos/2008/09/12/tutsi-blog-aktuell/
They sued people in germany to up to 6000€ for their picutres.
Lawyers in germany even have a special consulting hotline just for the cases with "Marion's Kochbuch"

And there is even a documentary about their methods:

(All sources in german, sorry)
This is so retarded.
Well since they can't fuck Garry over this, just show them middle finger and carry on reposting their shitty pictures.
Whitehouse.gov has a help page for patent trolls if you need it garry
[editline]28th February 2014[/editline]
Idk if its info is useful in Europe
Guys, I don't think this DMCA will wok.
Imagine if it worked and the image became a ban image.
That Wok.
Garry should make the wok the default avatar.

Does DMCA cover photoshoped images?
Does DMCA cover photoshoped images?
Depends on whether or not the editing is significant enough to be considered fair use.

hosted on imageshack, copyright of imageshack
This can't be real. Right?
I can confirm, we got this a while ago and discussed it on skype. Too bad hotlinking an image and not claiming it as one's own original wok is covered under fair use.
all they can do is ask us politely to stop. We're not advertising with it, using it for our own purposes, hosting it ourselves, or otherwise generating a profit from its existence.
Does DMCA cover photoshoped images?
parody act protects you if you photoshop and don't make claims that the original is yours
If I remember correctly, Hyperlinking is legal and rehosting is illegal.
An image of a wok posted 2 years ago used solely as a joke for a misspelt word. What the fuck?
If they're gonna talk the talk they better be able to wok the wok.
Screw Marions Kochbuch I post my Wok if I want to

Surely the DMCA isn't involved at all, the US isn't involved in any of this so surely a US law doesn't cover anyone.
DMCA only applies in the US so this is pointless anyway.

The dotcom TLD probably made them think that its US based.
LONG LIVE THE FACEPUNCH WOK!
