He also argued that more than 13,500 service members have been fired under the policy since it was enacted, and that the policy damages the military by forcing it to reject talented people in a time of war. In the ruling, Judge Phillips stated the following: "The Act punishes servicemembers with discharge for writing a private letter, in a foreign language, to a person of the same sex with whom they shared an intimate relationship before volunteering for military service. It subjects them to discharge for writing private e-mail messages, in a manner otherwise approved, to friends or family members, if those communications might lead the (unauthorized) reader to discern the writer's sexual orientation. These consequences demonstrate that the Act's restrictions on speech are broader than reasonably necessary to protect the Government's interest. Moreover, the Act's restrictions on speech lead to the discharge of servicemembers with qualifications in critically-needed occupations, such as foreign language fluency and information technology. The net effect of these discharges, as revealed not only in the testimony of the lay witnesses but also of the experts who testified and Defendants' own admissions regarding the numbers of servicemembers discharged and the costs of recruiting and maintaining an all-volunteer military force, compel the conclusion that the Act restricts speech more than reasonably necessary to protect the Government's interests." Government lawyers are arguing that Phillips lacks the authority to issue a nationwide injunction and the policy's fate should be determined by Congress. Congress, on the other hand, has had 16 years to repeal the discriminatory law, and haven’t accomplished it yet even though a Washington Post-ABC Poll conducted in February 2010 showed that 75% of Americans supported a repeal. Just because a court says the ban was unconstitutional doesn't mean too much. Now they're allowed to serve, but I have no idea why they would want to. They'll just be badgered and shoved around in the forces.

Being gay is just another thing they pick on along with their race, background, hometown, attitude and whatever else makes them stand out. If they can't handle the hazing like every other soldier then it's not a matter of being gay, it's being able to handle it. On the other hand a lot of guys don't harass each other anyway so they probably wouldn't start just because someone is gay. If they're a homophobic dickbag then they're just another asshole.
