Judge James Brady also banned prosecutors from trying Albert Woodfox, 68, for a third time. He has been in solitary confinement since 18 April 1972 after a prison riot that resulted in the death of a guard. Woodfox was tried twice for the guard's death, but both convictions were later overturned. He denies all the charges. On Monday, Judge Brady ordered the unconditional release of Woodfox and barred a third trial, saying it could not be fair. But a spokesman for the Louisiana attorney general said prosecutors would appeal "to make sure this murderer stays in prison and remains fully accountable for his actions".
Don't you have Double Jeopardy in the US?
imagine being stuck in prison since the 1970s. missing the entire rise of electronics. jesus.
Don't you have Double Jeopardy in the US?
There's probably a loophole when it gets overturned.
Don't you have Double Jeopardy in the US?
probably different convictions/charges
Holyshit, that must be terrifying
imagine being stuck in prison since the 1970s. missing the entire rise of electronics. jesus.
In solitary confinement no less.
I get that he killed a guy but jesus. How do you even live after that long without contact?
I get that he killed a guy but jesus. How do you even live after that long without contact?
No choice not to. Can't expect him to be released and be mentally sane, less so adapt to society, that would be one hell of a feat on his side.
At the point that pretty much everyone on this forum was born, this guy had already been in a small room for decades. The whole time I've been on this earth he's just been sitting in a 6x8ft room
Jesus, that long in a white box without contact, I'd be surprised if he's still sane...
Hes going to see people with new Robo-Prosthetic's and lose his shit.
Yeah I'd go insane after about a month of solitary, I don't even know how you can be allowed to do it to someone for 43 years.

If the punishment is pretty much guaranteed to break your sanity then wouldn't that qualify?

I mean, you're life is theirs to control now, they could have shut this guy out from the world completely had they wanted to grease enough palms. And for some people I'm sure that happens more than we'd all like to think it can.
This could very well be one of those cases where it's better to keep him locked up. Solitary confinement is known to have harmful effects on people after 3 months, I don't even want to imagine what 43 years of solitary confinement have done to his mind.

Putting him back in prison would probably make them stick him in solitary again.
He should have a state funded carer or something to help him re-integrate for like a year

If I were locked in a room for four decades, there'd be no doubt I'd go Oldboy on everyone's ass the second I was released.
I would have been fucked for life and probably killed myself the moment I got out. Post-incarceration suicides are a thing.
Over 70% of the victims of post-incarceration suicides (considered within the first year post-release for the purpose of the study where these figures are from) are previously diagnosed with a psychiatric condition, 20% were admitted to prison health care for mental illness and 30% had received mental health treatment after release. Source: D. Pratt, L. Appleby, M. Piper, R. Webb, and J. Shaw. (2010). Suicide in recently released prisoners: A case-control study. Psychological Medicine, 40(5):827-835. There is a very large chance this man will kill him self within the next year (if he is released this year). Sad, but true.
Reminds me of Brooks from Shawshank Redemption. Hope he won't end up the same.
Don't you have Double Jeopardy in the US?
For the same charges. It's easy to throw on multiple charges for one crime.
Holyshit, that must be terrifying
The end of Shawshank Redemption rings a bell.
while killing is terrible from what I read he only killed one person? 40+ years of solitary for one murder?
I remember reading a thing a few years ago by a guy who was in solitary for several decades and pleading for his release. I wonder if it was this same guy? There was actually a thread about it here on Facepunch.
while killing is terrible from what I read he only killed one person? 40+ years of solitary for one murder?
If he wasn't exactly a model citizen in prison, that may have earned him that.
Unless this guy is a child raping cannibal, I would say 43 years of solitary confinement if more than enough punishment. However, I think the state should try to help him out cause in the outside world, there's probably no opportunities for him other than becoming a street bum.
