Police said the two children, and several others, had been left in the care of a 16-year-old girl who had mental disabilities, the Kansas City Star newspaper reports. The incident happened on Saturday when no adults were present at the house, where the baby boy had reportedly been staying for the past two weeks. Police initially thought Jermane had drowned accidentally until the five-year-old allegedly told them she did it on purpose. The girl allegedly said she drowned Jermane because he "made too much noise" and "cried too much". Authorities at the Jackson County Family Court have questioned whether she has the mental capacity to understand the permanence of death and could be charged with homicide. "The mind of a five-year-old is not really capable of formalising intent for homicide," juvenile officer Mary Marquez said. Jermane's father had been travelling from St Louis to pick him up and take him home the day he died. On his Facebook page, Jermane Johnson Senior wrote: "I just got to ask the hardest question that no parent should never answer. I'm pretty sure she knew what she was doing. However, she's so young. I don't know what an appropriate punishment would be. Personally, if I were the parent I would've backhanded that bitch so hard I'd break her neck. And that's why I'm never having children.

If I remember correctly, children are able to differentiate, to a basic degree, right and wrong at a younger age than 5. However, you can't really throw the girl in prison.
Even if she lacks the mental capacity to realize that what she did was wrong and that people can't be brought back from the dead, she still needs some kind of erm... Help of some sort.
She's 5. She couldn't have possibly done this with the intent to "kill" the toddler.

When she gets older imagine how much this will screw with her. Like, at this point she's very young so she's gonna grow up with knowledge that she did this in an exceptional view, as just a normal bad thing she did. And then one day it's going to hit her, and it's going to suck.

She may have had the intent to silence the baby but you don't even understand killing at 5 years old so saying that she had the intent to kill the toddler is wrong.

A sad series of events, but really the girl is five years old. She doesn't quite have a mature brain and kids do some strange things when they are at this stage of development.

If I don't make it rich in this life, I'm going to make damn sure that my kid will. I wish my parents put me into acting lessons etcetc when I was a kid. I got put into ice skating because my dad wanted me to go into the NHL. Unfortunately I decided to quit at a young age because my initial coach moved to Toronto and shit was never the same. I really regret quitting because I love Hockey, and I'm really good at it, other than ice skating of course.. And it really sucks to see all my friends playing in AAA hockey and some of them making it into the WHL which is a league or two before the NHL, just thinking that could be me.. it sucks. Any who, kinda off topic.. This is a really unfortunate event that didn't really need to happen, sucks they had that mentally handicapped 16 year old looking after them.

That's cute but no one really knows how to raise a child. There's no manual you can pull out of your ass and flip to a chapter on how to raise your child to be an intelligent gentle man/woman who gets into no trouble. They're not furbies. The majority of everyone who has a child thinks they're raising their child in the most perfect way possible. And it's not exactly a perfect world you're living in, is it?

Once I realized he was gone for good, the stark reality of being dead hit me hard.

Your never too old or too young to murder somebody. I hate how people say she has no ability to comprehend what she did--but how the hell do we know whats going on in her head? -__- (I knew the definition of killing and it being bad by 6. <.<)
