According to the phone records, Sauer, 18, was posting on Facebook about every 90 seconds.
"I think she was probably (texting) to stay awake, she was probably tired," Taylor's father, Clay Sauer, told Ann Curry on The TODAY Show. "But that's not a reason to do it, and the kids think they're invincible. To them, (texting) is not distracting, they're so proficient at texting, that they don't feel it's distracted driving."
Taylor's parents have since become activists in their home state of Idaho, trying to get the government to pass laws against texting while driving.

First off, I'm pretty sure those laws already exist. Second, this is her own stupid fault and this would have happened whether it were legal or not.

I text and drive at times, but never going beyond 45 mph. At higher speeds, you need complete attention to the roads. That woman was just an idiot and she paid the price for it.

It's illegal in my state (NJ) but from what I understand, a policeman cannot pull you over for it. They can only fine you for texting and driving if you were doing it and were pulled over for another violation.
But even then, it's not that hard to hide, just keep your phone out of eyesight. Making it illegal won't stop anyone - especially teenagers and young adults. It doesn't stop me, but I have the common sense enough to at least put my driving as priority and not the text. It sometimes takes me 10-15 minutes to type out a quick, short text because I'm so focused on driving instead of what I'm typing.

It was always dangerous, but got worse with the introduction of touch screens.
At least with a physical keypad, you didn't need to look down every time you went to type a letter.
