This only counts towards the usage of Assassin's Creed Unity. So it's not a free pass.

The fact they had to do this just explains to me that Ubisoft has fucked up and they know it. They just keeps on digging and shooting themselves in the foot at the same time.

Jesus I thought they were just trying to be nice and try to salvage their reputation a bit by giving compensation for all the troubles. Here it was just a decoy to trick people and save their own asses from their legal obligations as a company.

Wait what is the big deal about this? Of course they are giving the free game as a compensation and would not want future lawsuits. I'm guessing you could sue them if you did not accept the free game, but then they would have an argument saying that they tried to make right by offering you a game of similar value or something and that you refused.
Completely illegal and unenforcable. All this does is worsens their public image.

And I completely agree, one free game offer does not make up for a buggy game that was highly anticipated and I'm guessing that is what you would have to argue if you were to refuse the free game and decide to sue Ubisoft. Free game is almost OK compensation but, it'd just be better if they bug tested. they should instead just give a refund for their mistake.s

Apologize sincerely. So far they've patched Unity and made it worse.
before y'all jump at ubisoft like they're the only people who do this, please read the steam tos you all agreed to. "YOU UNDERSTAND THAT YOU AND VALVE ARE GIVING UP THE RIGHT TO SUE IN COURT AND TO HAVE A TRIAL BEFORE A JUDGE OR JURY." They handled the situation wrong and messed it up even worse. But my point still stands, the clause itself is not the problem and it is not something worth mentioning unless your sole intention is to cause drama and more bad blood. It is probably a boilerplate agreement and apart from the whole issue with whether a ToS would hold up in court or not, it makes complete sense. The company is providing the free game as an apology. Now whether that apology is enough to make it up for the shoddy product is up to the individual, but I completely agree on the point that if someone accepts the apology Ubisoft should have some protection against lawsuits. If you don't accept the apology then you of course have every right to seek out your rights. Also I would say that if the free game is buggy and/or not working I am sure the courts would find in your favour.

As far as I know, you can't sign your rights away. Period. certainly not with a User Agreement that you're shown AFTER you bought the product, that then says you can't use what you just bought unless you agree to it
