A law enforcement source says Dr. Conrad Murray will be prosecuted on a theory of gross negligence. The source spoke on condition of anonymity because the investigation remains open.
Before an indictment can be sought, the source says the Los Angeles Police Department will follow the formality of presenting the case to the district attorney. Both agencies have been working on the case along with the U.S. Drug Enforcement Agency and the California Bureau of Narcotics Enforcement since Jackson died in June.
Michael Jackson's blood contained a lethal level of propofol - a powerful anesthetic normally excluded for use in hospitals - when he was found unresponsive in his home on June 25.
Officials had focused on Dr. Conrad Murray, Jackson's doctor early on in the investigation into Jackson's death.
Murray told a Los Angeles police officer he administered several drugs to Jackson the day he died, including 25 milligrams of the sedative, which he gave intravenously, but that he never ordered, purchased or received any of the propofol. Instead, Murray claims he found about eight bottles of it in Jackson's home along with numerous other vials and pills.
Murray reportedly gave the entertainer the powerful anesthetic propofol to help him sleep hours before his death.
