TWO brothers were given community orders after a burglary attempt described in court as wholly incompetent.
Clive Webster, 30, and his brother Kelvin Webster, 25, admitted burglary when they appeared before North Devon Magistrates' Court.
The court heard police received a 999 call at about 1am on May 16 after banging was heard at the rear of Pedlars department store in Ilfracombe High Street.
Officers arrived to find the Webster brothers crouched below a large wall at the rear of the property.
The pair, who were covered in brick dust, were found with a screwdriver, a crowbar and a hammer. A ladder was leaning against the shop wall and at the top of the ladder was a two-foot hole in the brick wall.
Police disturbed the pair before they had a chance to enter the building and nothing was taken from the store.
Tim Hook, defending Clive Webster, said: "This was a wholly incompetent attempt at a burglary.
"In fact, were there a school of burglary this example might be given to students on the first day to demonstrate what not to do.
"The hole made by the pair in the wall was just six feet away from a burglar alarm.
"Also imagine, if you will, the rather ungainly sight of my 17 stone client inserting himself into such a small gap.
"From every viewpoint they were bound to fail. It was a misguided and instant decision made only because Pedlars is so near to their own house."
Laurence Overend, defending Kelvin Webster, added: "It was an inevitably doomed enterprise. Nothing was taken and even if they had gained entry, there was limited stock in the room they would have accessed."
The court was told both men suffered from mental health problems and had attempted the break-in to provide financial support for Clive Webster's five children.
Magistrates were told Clive Webster, who gave an address in High Street, Ilfracombe, had a previous conviction for burglary in 2001.
Kelvin, of Oxford Grove, Ilfracombe, had two previous convictions for shoplifting and one for handling stolen goods.
Kelvin Webster was given a curfew with electronic tagging for two months.
His older brother was ordered to do 100 hours unpaid work.
The pair were also each ordered to pay £150 in compensation.[/release]
