• Whiteboy7thst's possession charges dropped after being swatted last month
The prank call led police to believe they would find an armed and suicidal man waiting for them. Instead, they found Wachs unarmed and healthy. But they did come across at least 30 grams of marijuana. Wachs and his housemate, Kelly Popp, both faced charges of possession of marijuana with intent to deliver, a felony class offence. Many had speculated about whether the charges could stand, as the police didn’t have a warrant to search the property, but were instead responding to an emergency call. Prosecutors seem to have agreed. They told the Chicago Tribune that the “unique set of circumstances” surrounding the arrest most likely meant that the evidence would “not have survived a motion to suppress.”
source This guy must feel like the luckiest motherfucker in the world right now
would be unconstitutional if they did. [editline]18th September 2014[/editline] its like going in looking for apples, but they aren't any, so we throw down for the oranges even though they're two totally different things.

This should have never even been a question, in fact the officers shouldn't have even thought twice about charging him for it.

this is sure gonna rile up the "well he deserved it for owning weed" crowd
I was actually talking to someone about this earlier. I said that the charges should be dropped due to the call that was filed being unlawful and fraudulent/false. The only probable cause they had to be in the house to begin with was bullshit so anything found should have been tossed out. Glad they did the best thing and dropped the charges.
wow the system worked....for once
I remember that thread when it was announced and there were a lot of people like "he deserved everything he got for having weed" wonder how they feel now
I remember that thread when it was announced and there were a lot of people like "he deserved everything he got for having weed" wonder how they feel now
I'm willing to believe that people were joking when they said that.
this is sure gonna rile up the "well he deserved it for owning weed" crowd
I hope you're not expecting to find that on Facepunch, we're pretty pro-legalization (and when that fails, pro-4th amendment at least)
Regardless, having marijuana in your house as a streamer is a stupid thing to do. This swatting thing is quite regular for the bigger guys to the point where some of the police know them by name and apologize throughout. If I were some sort of streamer, I'd bury that shit.
I hope you're not expecting to find that on Facepunch, we're pretty pro-legalization (and when that fails, pro-4th amendment at least)
You should've seen the thread that had the video of the swatting.
this is sure gonna rile up the "well he deserved it for owning weed" crowd
Possession is illegal but the evidence was obtained illegally and therefore can't be used against him. Not much else to say.
why don't you just not have weed if it's going to get you in trouble? if ice cream was illegal I would just sack up and move on
this is sure gonna rile up the "well he deserved it for owning weed" crowd
well they can fuck off so
why don't you just not have weed if it's going to get you in trouble? if ice cream was illegal I would just sack up and move on
I can't really tell if this is trying to be satire or not.
why don't you just not have weed if it's going to get you in trouble? if ice cream was illegal I would just sack up and move on
"man, we're having a drought" now means "All the ice cream is gone"
this is sure gonna rile up the "well he deserved it for owning weed" crowd
I generally do not support the possession or use of marijuana for non-medical purposes, but that does not change the fact that the evidence was obtained in an unlawful manner due to the officers searching the building on a false emergency report, as such it should not be used in any legal proceedings and the people responsible for making the false-report that led to this search should be charged for doing as such. Like it or not the law is very clear on this matter, and laws of such importance are not the type that can only be upheld when it's pleasant.
While the investigation against Wachs is now over, the police say they're still attempting to track the person or people responsible for the prank, telling the Tribune that they have "developed some leads in the case."
I wonder if they realize the person who did it got their IP + name and near by city was leaked. Not to mention the group he did it for has their teamspeak info available, and he's often in said teamspeak. Also recordings of the actual call were released, are the police even trying?

I don't think I've ever seen a police statement not be cryptic as fuck when they detail how far into an investigation they are. Anyway more importantly, does he get his weed back now?
Pretty sure if the police come across something while searching for evidence of another crime it's fair game, problem is in this case there wasn't another crime being committed.
No, you can not go in for guns and come out on pot. It doesn't really work that way.
This should have never even been a question, in fact the officers shouldn't have even thought twice about charging him for it.
Not sure why I'm getting disagreed with? Did I word this badly somehow, or are people saying he should have been jailed?
Swatting is probably the most dumbest fucking thing in the world, police should now focus their attention on who made the call
This should have never even been a question, in fact the officers shouldn't have even thought twice about charging him for it.
Evidence found during illegal searches can't be used in court, because it was found illegally. Technically they had no search warrant, it was a false flag, given the circumstances any substances found can't be used in court. -edit- And in the case you meant they shouldn't have thought twice about arresting him because they knew they had no evidence, then I agree. You should probably word that a little more clear though, it sounds like you're justifying the arrest.
did they give him his weed back

I sincerely hope it's appropriately punished for in the US.
As long as you dont pirate you'll be fine kidz. Do drugs, dont pirate. (User was permabanned for this post ("Gimmick" - Blazyd))
What the fuck? I sincerely hope it's appropriately punished for in the US.
To my knowledge it's hard to catch the person doing it.
What the fuck? I sincerely hope it's appropriately punished for in the US.
Yeah it's really difficult to actually go after someone who does it. These SWAT events cost the tax payers like thousands of dollars too if it's serious. Like helicopters, At some point though, the police need to check first before sending all available units because some fuck called and said "I LIVE AT 1234 AND NORTHERN AND I AM GOING TO KILL MY GIRLFRIEND". It's really dumb. Also, just to make it clear to anyone reading my comment from before, I know that these people should not be tried on possession charges. I'm an advocate and I have my medical card. I'm just saying that if these cops are so overzealous that they'll bust down your door and point guns at you, they're going to try and make it worth their while. Don't be surprised when you are charged and the system doesn't work out like it did for this kid.
