a judiciary body's role isn't to create law, they interpret the law, they were probably as horrified about this ruling as anyone if they found public masturbation to be legal, don't blame the judiciary, blame the legislature for not making it clearly illegal

Such as in my state (texas) bestiality is technically legal. Again journalists show how much they know about the law when they can't even fathom that the difference between felony, misdemeanor, infraction and violation might exist in other countries too. You guys might not know it too, so to put it simply, a crime, by definition, is punished with jail. The CoC rightly pointed out that the criminal part of the act (going to jail) was removed from the Penal Code, but that doesn't mean you can do it. It's still illegal, only not punished by jail, because it's not a crime anymore, but an [I]illecito[/I]. Just like jaywalking is illegal, or vandalism is illegal, but not punished with jail. Remember that 99% time anglophone journalists report on civil law rulings, they get it wrong. Haven't seen a single article about these european supreme courts ruling about something that was actually correct.
