I'll make it clear that Flynn expressing these rights does not mean he's guilty. There's plenty of ways you can incriminate yourself without being guilty. But it's also important to note that apparently no Obama White House picks ever invoked this right. Things are getting very, very tricky.

Things are getting very, very tricky.[/QUOTE] When he tried to get immunity against prosecution in return for his revelations, they (Senate committee) said that they were shooting that down, but said it might change in the future. I understand the concept of the 5th being used here to avoid incriminating himself, but that's still not going to save him if Congress introduces proceedings against him for holding said body in contempt.

The entire Trump administration is implicated in potential TREASON: their only chance at legitimacy in the eyes of the country and the world is to put these charges to rest completely. There can be no doubt that they have fully complied with the investigation and made no efforts at obfuscation or obstruction. Basically: this is fucking shady. Trump and his pals should be cooperating with this investigation completely and publicly so that they can put it behind them and move on. That they are doing the exact opposite, trying to burden and obstruct it, is both suspicious and concerning. The legitimacy of our government is in question -- shouldn't they be trying to reassure us that the fears are unfounded? Furthermore, he's doing more than just refusing to testify: he's refusing to comply with a subpoena for records. His 5th amendment rights do not extend to burying evidence.

But with all the other evidence around... I'd give it a 90% chance he's guilty.

Isn't this just going to end up screwing Flynn over? It only makes him look uncooperative at best and they can still get a warrant to seize the stuff they were subpoenaing him for.

About the records, can't they get a warrant, and charge Flynn if he refuses to comply? Or a FOIA (Freedom of Information Act) request on the records?

Contempt of Congress is kind of complicated and rarely enforced, which is why the FBI/special counsel investigation is really more important because they are better equipped to overcome this kind of stuff
