Birthday gift right before divorce, man takes it back or woman gets it?

Imagine a man bought his wife a birthday gift - a large flatscreen television to put in their bedroom. Then, in events completely unrelated to this gift, they grow apart and argue extensively, leading to a divorce two weeks later. In this time, the TV was left neglected, sitting in its box, unopened in the living room, because they had not yet found a time to call the comcast guy or whoever to set up service for this new TV.
So, who should keep the TV:
The man, because they're getting divorced and he doesn't feel like letting her take this unopened TV which he paid for out of his own pocket, and his wife didn't get it set up, showing she wasn't particularly attached to it
-OR-
The wife, because it was clearly a gift to her and the man shouldn't be able to take it back just like that?
The man because it's always the womens fault.

As much as I hate to say it, the woman. It doesn't matter how much she likes it or not, it was a gift to her and it's not his to take back; unless she offers to give it to him of course.
The man should marry the TV.

It's a gift, unless you have no idea how gifting works, the woman keeps it.
I would try to get it back, but if it was pronounced as a gift it's hers.

You don't take back a gift after it has been given.
Legally, it's the women's. Personally, I think it should be the man's because that's just a dick move to do.
He gifted the TV to her, she keeps it but he gets the wedding ring back.
It kinda depends on what terms they leave each other. But I'd say if they leave on good terms the man should be selfless enough to leave the TV. If the woman is pissed off to no end then the man should take the TV because she'd hate the thing anyway.
Well it all depends on if it can fit in the kitchen or not.
Leave it. Show her that you could 1. No longer care anymore 2. Willing to leave a part of himself to her.
Either way she's going to be moping back.
