Before you jump ahead, let me explain my story. I've been trying to do good this year, really turn things around, you know? I'm getting perfect grades so far, not arguing with teachers and faculty, and kissing ass whenever I can. Even though I absolutely hate agreeing with some of these people, I'm doing what I have to do to get by. I was suspended last year (Sophomore year) for 3 days, because I refused to give a teacher my phone. In my defense, he looked like a Nazi. Anyways, I'm trying to stay out of old habits and not be 'insubordinate' with the authority in the school (teachers, principles, security guards, etc.) Well, today I suppose I was just in the wrong place at the wrong time. So I was walking down the hall after my Astronomy class, on my way to my locker to grab my lunch. I was listening to my Zune (yes I have a Zune, I'm that gay) and texting. I rounded the corner to go to my locker as I was Tweeting the lyrics to a song (yes I have a Twitter, I'm that gay.) The song, Images of The Apocalypse by The Insurgence, has a lyric in it that says, "I've got a gun, I'm gonna do it!" So me being me decided that was worth Tweeting to the people who are dumb enough to read my garbage. Before I could hit my enter key, I'm stopped by a teacher, who has her palm out, as if she wanted a high five. So I went ahead and gave her some skin. I guess that isn't what she wanted because she got a tad upset about that. She asked for my phone, I gave it to her, yadda yadda yadda I carry on with my day. I get to lunch and eat my beautifully prepared ham, salami, and muenster cheese sandwich, accompanied by a Mountain Dew. I finish up my lunch and head out with the crowd, and stop to chit chat with a few friends, considering we had 10 minutes to get to class. All of the sudden I feel a hand on my shoulder, I turn around to see the principal with a welcoming face. He's a nice enough guy who's gotten me off the hook a good number of times. I figured he just wanted to make sure I wasn't arguing with the teacher about my phone or anything so I happily followed him into his office. He ended up taking me into another principal's office, I don't know the guy, but he seems like a royal cunt. They begin to ask me a few questions about my grades and stuff, very unimportant things that I didn't mind answering. And then it hits me... something's wrong here. After this revelation I finally say, "This obviously isn't about me getting my phone back. What did I do this time..." They get serious at that point, questioning me about who I'm texting in class and who has a gun. I was honestly a little confused as to what they were talking about. Gun? Who the fuck has a gun? I sat for a second kind of detached from the conversation, just thinking about what they might be talking about. And it all made sense... Oh.... They think I have a gun... I quickly explained what happened, how it's not a text and how it's on Twitter, how it's the lyric of a song. I handed them my Zune to help argue my case of it being a song lyric, but they were pretty convinced that I had my head set on shooting people. They questioned me for a while then took me to another office where they questioned me until my dad arrived. From there I just kind of sat in the waiting room for my dad to come out and for me to go home. Needless to say I got home an hour earlier than I should, and now I'm facing 2 days of ISS. Which honestly isn't bad, but I shouldn't be punished for something that actually wasn't even posted. I didn't have a chance to hit the button to send it, so technically it hasn't become "Intellectual property" as they like to call it. It's illegal for the teacher to even read anything on my phone. If I wanted to be a big enough dick I could sue the school. Considering I don't have the money for a lawyer, that probably won't happen, but you get the point. They've denied my request to go to my girlfriends homecoming dance (she goes to another school, so you have to get papers signed by an administrator.) It's been over a year and I haven't been able to take her to a dance. Last year I couldn't because I was in physical therapy. Here's the song I was in trouble for quoting. No, it is not metal. I feel more motivated to bring a gun now than before. Bastards... I'm not going to obviously, but it pissed me off quite a bit. Sue school, shoot errybody, fuck the police. But seriously, just don't twitter unnecessarily during school hours, the faculty are gonna be pricks about it no matter what
Wow. I really hate schools some times. Sorry about the ISS bro. Not much you can do :( (User was permabanned for this post ("Alt..." - Autumn))
Wow. I really hate schools some times. Sorry about the ISS bro. Not much you can do :(
I really don't care about the ISS, it's how I'm going to have to disappoint my girlfriend that is bothering me so bad.
Help people, build shit, go to school.
Just take out your aggression on source no need to hurt us!

To be fair though, 'I've got a gun' is a dumb this to tweet while you're in school. Plus I'm sure nobody cares about what song you're listening to. Even on Twitter...

It's the fact that the teacher cannot go through my phone.
As if you needed another reason to stop posting lyrics on social networking sites.
Kill people, burn shit, fuck shool.
My friend posted something like that on her Facebook wall earlier this year. She got a week of OSS and had to deactivate her Facebook.

I handed over my phone as any other student would, it's not like I'm walking around talking on the phone about what time the bomb is supposed to go off. I was walking through the hall. That isn't exactly 'probable cause.'

R.W. closed the phone and handed it to the teacher. Although he lacked any suspicion of further wrongdoing by R.W., Unnamed Defendant opened the phone to review the personal pictures stored on it and taken by R.W. while at his home. Several photographs stored on the phone depicted R.W. dancing in his home bathroom and one photograph, also taken in the bathroom, showed B., another SMS student, holding a B.B. gun. Whatever state that happened in, I can assure you the laws here are different. The teacher needs some type of probable cause to search it. If she doesn't have that, they cannot legally go through my property.

My screen was not on, she could not see it. She had to be trying to go through my phone to see it.

http://www.facepunch.com/threads/778487 Scroll down to where "school" is the first thing on the list of what makes a bad idea for a thread. We don't really care what petty injustice you suffered in school, just deal with it and you'll be out in a few years.
How has this not gotten to anyone? My screen was not on, she could not see it. She had to be trying to go through my phone to see it.
Then you shouldn't have had your damn phone out in the first place. Or you could have just removed your sim card/phone battery
That's nice and all, but my screen was off. And she wasn't exactly going to go through my pictures.
at first i thought they were going to lock you up in the international space station or something
I can cope with that.
If you couldn't POSSIBLY wait to tell supposedly NO-ONE these song lyrics you deserve it

That's really not a smart thing to tweet about. Sucks you got suspended though.

Since she has no legal rights to read what was on the phone then the "evidence" she saw should be negated. Threaten to sue or some bullshit, yea I know you said you can't afford a lawyer but the threat itself would scare my school shitless.
"The district court ruled, however, that the student had stated a valid due process claim against the school for the disciplinary measures against him based on what was found on the phone during the search." Not unconstitutional, still illegal
I do not see anything there that states that applies to more than anything than the punishments applied from the school after the search which I did not touch upon I will probably eat my words and look like an idiot but I do believe that says the disciplinary measures against the student were illegal but not the search itself
