• Nvidia gets away will bait&switch - 279$ Compaq as replacement for all defective machines

Title's confusing because I couldn't figure out a way to fit this bullshit into the title. http://www.pointoflaw.com/archives/2011/05/court-rules-for.php http://yro.slashdot.org/story/11/05/02/213243/NVIDIA-Gets-Away-With-Bait-and-Switch
"As part of a December 2010 settlement agreement, NVIDIA agreed to provide all owners of laptops containing a defective NVIDIA GPU with a laptop of similar kind and value. In February, NVIDIA announced that a $279 single-core Compaq CQ56 would be provided as a replacement to all laptops — from $2500 dual-core tablet PCs to $2000 17" entertainment notebooks. Ted Frank, from the Center for Class Action Fairness, filed an objection to the court, which was overruled by Judge Ware today. Once again, the consumers of a class action lawsuit lose."

Court rules for NVIDIA The short opinion is self-explanatory (though it confuses a motion to enforce the settlement with an "objection"). As I stated earlier, if the court believed the intellectually dishonest report of Milberg's expert witness, the consumers would lose, and that's exactly what happened. All those consumer advocates complaining that AT&T Mobility v. Concepcion would take away consumers' ability to engage in class actions were completely silent in this class action where plaintiffs' lawyers extinguished valuable claims in exchange for a $13 million payoff. Every single one of my clients would have been better off with AT&T Mobility's arbitration provision rather than this outrageous class action rip-off. The class members didn't even get a chance to object or opt-out because of the bait-and-switch between what the notice promised and what was offered in the settlement. The question then becomes: why did Milberg submit such an intellectually dishonest expert report to minimize the likelihood that their clients would receive any relief? If I were a class member, I'd be looking for a good legal malpractice attorney right now to sue over this breach of fiduciary duty. It would be nice if the "consumer advocates" fighting against freedom of contract actually advocated for consumers instead of attorneys and spoke up here.

This is a story about class action lawyers who sued on behalf of millions of people who bought Dell, Apple and H-P computers with a faulty chip. Nvidia, the chip maker, took $509 million in reserves to pay for the defects. And when Nvidia finally settled, it said the litigation was a “causative factor” in pushing computer makers to extend their warranties on PCs. That is the good part of the story. Then the lawyers settled. Beyond those extended warranties—the value of which was never quantified–here is how the statistics break down: Of the millions of customers who received notice of the settlement, only 28,355 submitted a claim for which they will receive total value of roughly $10 million. Before the court knew so few claims would be made, the court approved $13 million in legal fees, supported by Nvidia along the way. Just so you do not think that is a typo, I will repeat that: The legal fees were $13 million. The settlement was $10 million. This is the bad part of the story.
Rest of this one here: http://blogs.wsj.com/deals/2011/03/24/dealpolitik-the-good-the-bad-and-the-ugly-of-class-actions/ TL;DR Machines (including laptops) have defective GPUs. Judge agrees to 10$ million settlement in class-action suit. Not enough for actual fucking replacements of the machines affected. 13$ million in fucking legal fees go to lawyers. Consumers get fucked up the ass. Fuck working 3D on Linux, I'm buying AMD in the future.
AMD has shittier quality. Blame the fucking system. This coming from someone who is currently running an AMD processor with an ATI card. As for the corporation being able to get away with this shit, it was really to be expected.
Wait, so if your 2000$ laptop had a broken GPU, you'd get a 300$ craptop as replacement?
Cmon Nvidia, I thought you were cool.
AMD has shittier quality. Blame the fucking system. This coming from someone who is currently running an AMD processor with an ATI card.
Dumbest fucking comment I've ever seen.
AMD has shittier quality. Blame the fucking system. This coming from someone who is currently running an AMD processor with an ATI card.
I'm running a Phenom II X2 555 Black Edition. Core unlocked to a quad-core. Overclocked to 3.5GHz. And I'm also running to 5770. My experience with AMD has proven that they're god-tier, at least in my eyes.

As for cpu's they haven't had a chance of competing with intel other than their 555s unlocking to quads. Maybe Bulldozer will change that but as it stands intel is ahead in the cpu department while AMD seems to have the price-performance advantage against nvidia in the gpu department.
Soo, this is for the laptops that suffered from the dreaded Geforce Mobile 8x00 series??
What do you mean cool? Haven't you seen the GTX 590? :v:
Reminds me, by toaster broke yesterday.
Cmon Nvidia, I thought you were cool.
What do you mean cool? Haven't you seen the GTX 590? :v:
This is why I prefer ATI. Their drivers may suck but they don't pull off stupid gimmicky bullshit all the time. [sp]PhysX[/sp]
ATI is pretty cool, if I say so myself
The American legal system is disgusting.
Nvidia should be a man and replace these peoples computers. Who cares about CUDA, PHYSX, 3D, and their video cards. you know this for a fact now, once they slump their quality again, you're going to be the one paying. Not them. Fuck their business model.
AMD has shittier quality. Blame the fucking system.
AMD has shittier quality. Blame the fucking system. This coming from someone who is currently running an AMD processor with an ATI card.
AMD is better than NVidia 9 times out of 10. What the fuck are you talking about
they just have to make a usable version of CCC [editline]2nd May 2011[/editline] 3D is stupid gimmicky bullshit
I just got my ati card coming from a 260 and the CCC is sort of weird. I had to enable, disable, enable and then finally disable gpu scaling to get my monitor to display higher than 800x600 and I find the layout quite strange. They could definitely improve but hey at least the drivers work. Cough...creative...cough. [editline]3rd May 2011[/editline]
AMD is better than NVidia 9 times out of 10. What the fuck are you talking about
Oh lol. Mindless ati fanboy awaaaay. Right now if I had $50 more when I bought my GPU I would have gone for nvidia anyday. The GTX 560 overclocking headroom is enormous. I don't see how it's 9 times out of 10 when nvidia dominated their hd 2000,3000 and to an extent 4000 series cards to the point where ati had to repeatedly drop prices. AMD won with their 5000 series and their 6000 series is neck and neck with nvidia but that 9/10 claim is a gross overstatement.
I don't really stick with a certain brand, I just go by word of mouth to determine which card is the best for the money.
i blame the legal system
Well that is what you get when people want to game the system to make money or not to lose money, a big fucking mess. That and judges are not infallible as well, and the circus that is the legislative as well. Though I am happy that I am not getting screwed by nVIDIA by this, and AMD is nice just not top of the line like Intel and nVIDIA is.
I'm running a Phenom II X2 555 Black Edition. Core unlocked to a quad-core. Overclocked to 3.5GHz. And I'm also running to 5770. My experience with AMD has proven that they're god-tier, at least in my eyes.
Except for their drivers. :sigh: Disclaimer: I say this as an AMD fanboy.
in all honesty, nobody with a working brain gives a shit about which company makes better graphics cards. NVidia cards work. AMD/ATI cards work. That's all that matters.
iNVidia cards work.
Except when they don't and they end up in court and fucking up customers
A couple of years ago I spent £700 on a Toshiba A500-17X laptop with an NVidia Geforce GT 230M graphics card. I later found out that the drivers are buggy as hell, and have been for a year since before I bought the laptop, and NVidia, rather than fix it, release "performance fixes" to the driver which actually makes the whole thing worse (video lags and sound starts to make staticy vibrating noises constantly, eventually resulting in a BSOD). My laptop is virtually unusable for gaming or watching movies. I built a new computer a few weeks ago, got an AMD graphics card. Runs like a dream. Fuck NVidia.
AMD is better than NVidia 9 times out of 10. What the fuck are you talking about
ATI has horrendous framerates when rendering anything OpenGL.
AMD is better than NVidia 9 times out of 10. What the fuck are you talking about
Except it's not.
ATI has horrendous framerates when rendering anything OpenGL.
ATI != AMD
ATI != AMD
ATI is owned by AMD. Ergo ATI is AMD tech.
AMD has shittier quality. Blame the fucking system. This coming from someone who is currently running an AMD processor with an ATI card.
The fuck has that got to do with this? This article is about a massive failure of the US legal system and Nvidia's complete disregard for it's customers, essentially.
