Didn't hear them give a warning or anything and you can even hear the guy asking if its ok (im guessing to film them that close or something) and they don't give him an answer.
Some of those officers are nothing but trigger happy meat heads. They have no discipline.
They should have numbers displayed prominently on their vests, so they can easy be identified by footage.

It's such low quality you wouldn't even be able to tell.

I'm 99% sure both parties have to consent to having any audio being recorded (e.g. their voices).

I, like many others, believe that a citizen should be able to take video of public figures such as police without their consent. They shouldn't be able to do so for other private citizens, of course.
Regarding what you are saying, I think at least one party has to consent for it not to be wiretaping, not sure about video.
Honestly both the media and the police are blowing this all out of proportion. From what I saw when I visited the Wall St. protests these are a peaceful people that only intend to exchange ideas.
