30 days a time for arguing back really doesn't seem like justice.
lol yeah send someone to be even more conditioned into a hardened criminal because you want to be spiteful with your power. He even provoked her at the end. She already got her fines and conditions, why sentence someone to jail for something as trivial as emotion? Why not sentence her to 300 days of therapy instead?
30 days a time for arguing back really doesn't seem like justice.
yeah, this is nearly a whole year we're talking about, one that she'll never get back
What a manchild. I get feeling contempt for a domestic abuser but in that position you aren't expected to let emotions affect your judgement.
what a prick if you wanna be a judge you gotta be fully aware that people get pissed off at you when you sentence them, fuck off
Contempt of court is bullshit. It just gives judges a chance to treat people like a parent punishing a toddler. If someone talks shit in court, just remove them from the room, keep whatever is going on going without them. Problem solved. Then if they don't cool down and start shit like this again, then give them something.
contempt should be a flat sentence, non-consecutive.
It's just like a server admin in GMod or something

A Judge had his cellphone ring in court after he disallowed them to be used in court, he held himself in contempt of court and paid 50$ to the courtroom officer. There needs to be a certain mode of conduct and contempt of court should only mean when you breach it and, barring extreme action, only mean a small fine that stacks up. This was wielded wrongly. The judge should serve a year for how fucked up and how much disregard he has for life.
i get that this judge probably had low standards held for this woman to begin with and, frankly, she was kind of an asshat about it(since she basically just got self-evicted), but man he handled that terribly. he was clearly goading her into talking more and more.
Contempt of court should only apply to those attempting to disrupt the trial as a whole or threatening officers of the court/jury/etc. Being snappy is not that.
Judge is a power hungry cunt. A woman being upset that she can't go home isn't unreasonable and the judge just made the situation worse.
This is why the only two things out of your mouth should be 'Yes your honor' and 'More than fair your honor' Don't be pissing judges off, they can be cunts or cool dudes, it's best to just be chill
Judge was fair imo. The way these things work in American court is you keep your mouth shut and follow the rules, and only talk when you're asked to. Even if she was held for 30 days she could easily have been bailed out. She shouldn't have acted like a fool in court and shut her mouth after the first 30 day sentance
The way these things work in American court is you keep your mouth shut and follow the rules, and only talk when you're asked to.
Totally exclusive to America also because they're tough, and cool.
300 days? Looks like His Honour haven't learn the principle of proportionality in law school...
Not quite sure what she did to be in this situation but I don't blame her. What difference does it make to her how long she has to stay locked up now that she was just told she can't return home? At least by staying incarcerated she has a home. The judge was played like a damn fiddle.
The whole "If you are at a location first, and one of them arrives— then you have to immediately leave" is such abuseable horseshit. If I have business somewhere and one of them arrives just to fuck up my day I would be pretty irate too. I can understand her anger.
Like what a couple people had said in this thread, it would have been smarter of her to play it safe and not argue with the judge so that she wouldn't have to be incarcerated (Unless that's what she was going for so that she would have somewhere to live during the period of time that she wasn't allowed to have contact with that one guy. Although, that's probably not how the law works, so idk). With that said, though, the "punish suspects that talk back to the judge" aspect of contempt of court seems pretty silly and pointless regardless of what would have been smart to do in that situation. Just because something is the law doesn't mean that it's automatically righteous and fair in any way besides in a purely legal sense (since it became a law).
How is she gonna respect a no contact order if she won't even listen to the judge and back talking him. Play stupid games, win stupid prizes. This is what brought this video attention again.
An arrest warrant has been issued for an Elyria woman who was ordered jailed for 300 days last year for contempt of court after cursing at Elyria Municipal Court Judge Gary Bennett during a court appearance. Court records indicate that after Ebony Burks, 32, had served 88 days of her jail sentence she was released in December to participate in the residential Key for Women Program. But Burks lasted less than a month in the program, according to court records. “The defendant has been asked to leave treatment due to her negative behavior,” a Jan. 2 docket entry said. Bennett issued a warrant for Burks’ arrest Jan. 14 after she failed to report back to jail to serve out the remaining 212 days of her sentence. Burks was making a video appearance from the Lorain County Jail before Bennett on Aug. 14 when she began to argue with the judge, who began incrementally imposing jail time on her. He reached 200 days behind bars before Burks walked away from the camera. The judge then heard her making comments and asked if she had anything else to say, to which she replied, “(expletive) you!” Bennett then increased the jail time to 300 days. Burks has pleaded out in separate domestic violence and assault cases for which she was fined, given a suspended jail sentence and ordered to undergo a substance abuse evaluation.
What the fuck... How about punish her when she ACTUALLY commits a crime and goes back to her home. Her simply saying "I bet I do" isn't shit and this judge knows it. It's scary that regular people with ego/emotional problems can become the ones that can end/restrict other peoples lives.

Tell them "fuck you" and see what happens. Better yet, in the event you are banned and you make an appeal, be just as vulgar to them and watch what happens. You tell someone of authority to to fuck off and you get bitchslapped. Who would of guessed! It's almost like there's laws against being vulgar to other people.

imo it is a huge problem in the legal system when a judge can put someone behind bars 300 days with no trial and jury.
