So how are people like bigirpal allowed to keep running? Looking at his videos, they have a ton of music from other people, and he records a shitload of battlfield 3 (although recently his focus has widened a bit).

I don't think birgirpal has ads enabled on his channel, and the music he uses isn't from big labels or anything as far as I can tell.

He has a partnership (he has the channel banner and the name branding.)
And there are ads. Static image banner ads over his videos, as well as pre-video ads.
He also uses music like Need a Hero, Can't touch this, and devos whip it among others. I am pretty sure at least one of those is from a "big label"

I'm betting his network doesn't give a shit. I've reported people at machinima for it and got their channels ruined and it felt really good. If I knew a contact at his network I'd bring it up. But I don't think he's getting permission from the labels of those 80's and 90's big bands.

Bigirpal either has a machinima.com contract which pretty much opens doors for him in terms of usable content, or the fact he was pretty much one of the early ones to actually create fun BF3 videos gained him EAs respect. I know they've featured him in a few of their community BF3 videos, so it wouldn't surprise me.
He's got a point, but I can't take him seriously because he sounded like he was about to cry for the entire video. He also talks way too fast.
And jump cuts. Jump cuts for days.
EA is taking away our god-given right to comment over mario romhacks :(
Youtube networks like Thegamestation and Machinima, and probably some other networks too, have licenses which legally allow members to monetize game footage.
Yeah I would understand having gameplay footage be real, but I am mainly talking about the music. I seriously can't come up with any other conclusion except for he is just risking it. No way in hell he contacted them for permissions...
