Isn't this technically counter fitting a card? even if it is his they could theoretically nail him for this right?

I would like to point out that the Magstripe reader he used is NOT just a magstripe reader. The price difference between a unit that can only read cards (80% of the stuff out there) and a unit that can also WRITE track data back to the cards is around $120-$500, depending on the brand.

Creating a credit card without legitimate account information on it, on the other hand, is pointless. Credit cards only contain account info, not balance or anything like that so there is no way to fool a transaction machine. If there is not a legitimate account on the card to provide funds for the transaction, the transaction is declined. If however someone creates a fake credit card with real account info that is not their own, that constitutes fraud. I'm sure there are rules against cloning cards in credit/debit card terms of service, but the worst that can happen is your account gets closed and the more likely punishment is they simply ask you to stop.

Duplication, mutilation or modification of an issued card is grounds for Termination of Service with immediate payment of due credit. Even my transit pass has that in the terms and conditions.
