I'd say backseat moderation would be saying something like "A mod will ban you"
He was saying something more along the lines of "A mod could ban you"
For example, if I were to say I was going to post a shock image, and someone were to say "you could get banned for that" is it really backseat moderation?
However, if I were to make a post that could be considered "on the line" and that a mod would ban at their discretion, and someone were to come along and say "You are going to get banned" then yes, I would say that is backseat moderation.
