....What if the company wants to pay a less experienced woman because they'd prefer that over higher experience, higher pay? That would be illegal under this?
So if I’m reading this right, does this mean that men will not be able to negotiate for a higher salary than anyone else in a similar position regardless of prior experience, seniority, productivity, etc... if the anyone in that similar position just happens to be a woman? What’s going to prevent companies from keeping the wages of female employees low just so they have a legal excuse not to give male employees a raise?
Then you basically just need an employee with lower qualifications. I don't think that's really relevant in this case. If you need a longer term employee, you might be more inclined to hire someone with lower qualifications just because their pay expectations are lower and retaining them longer term is easier (since there's no resources spent on training new employees). Anyone overqualified for a position is more likely to request a different position or leave the company once they find a better paying job for their qualification. Obviously it's not that easy to decide on hiring people, but if you make me choose between 2 people that have the same skills required for some work they do (let's say for example something simple like entering data), with one being a PhD and one a highschool graduate, chances are I'd go for the latter.
This has actually caused some people to not write their college degrees into their CV's so that they don't get rejected due to "overqualification".
Though having large unemployment gaps also looks unappealing, but all that depends on how in depth the interviewer goes.

I'm sorry, but I'd run my business my way... If I want to do a good deed and hire someone off the street as a secretary who has finished say grade school - I'll happily teach them, give them a job, provide a roof, food, etc... but to pay them identical to someone who completed high school, or college, etc.. that doesn't seem right. Especially if I provide out of pocket expenses up front to ensure a roof over her head... Additionally there are people that have absolutely no common sense..... Don't put reds with whites... Don't put clothes in the washer when it is full of shit... Wash your hands after washing / cleaning the bathroom before you wash dishes... Wash the dishes FIRST if you plan on cleaning the bathroom.... Don't put EGGS on the bottom of the grocer bag with a watermelon on top of it... Don't put anything soft / destroyable under something heaver - ie bread under ice cream because condensation / moisture, and heavy on top of soft... I'm sorry, but I won't pay someone an equal amount if they have no common sense and have to be constantly monitored - they'd be fired. Maybe they'd claim discrimination but hell - if you ask for a job, claim you can do it, and don't do your job - you are in breach of contract.... If someone merits being paid for - they will be paid more... Not based on gender, race, height, sexual orientation, etc... but merit....
