So... What we have been doing for the longest time? I cannot really think of a time where we did not temporaily detainee people within federal/state prisons for breaking federal law.

Interesting article well worth the read. Striking that immigration has gone down so less immigrants to work in ag and the conditions and pay are so dire few Americans would want to do it. We're sending foreign nationals who have not had a hearing to prison to "house" them. They are called detainees because they are being detained. They may have broken the law, but they also may not have - they're being unreasonably detained and denied their constitutional right to a fair and speedy trial. And yes, that right applies to anybody in the US, not just citizens. This is like getting pulled over for speeding and then getting chucked in gen-pop federal prison while you're waiting for your trial. You're not being detained in a jail. You're not allowed to post bail. You're not allowed to see a judge to tell you what crimes you're being charged with. You're just sent to fucking prison before you even get to see a courtroom. This is unconstitutional - every single other person in federal prison has been convicted of a crime. None of these people have - they've been detained under suspicion of committing a crime, and they're being lumped into gen-pop federal prisons with convicted murderers, rapists, and other convicts. They have been convicted of nothing. They have been charged with no crime. If you don't see why this is fucked, I don't know what to say. A cop can't catch someone smoking weed and drive them straight over to prison and tell them they're going to prison for 40 years - there's a legal process where they're charged and convicted of a crime, in front of a judge. This is skipping right over that entire legal process, in the process separating children from their families. Absolute bastardization of our legal system.
