Source Samantha Ray Mears has been charged with wielding a machete in order to force a man to have sex with her. Court documents allege that Mears entered the residence of an ex-boyfriend while he was not home. When the man returned home, Mears reportedly confronted him with a machete, ordered him to get on the bed, and remove his clothes. Mears, 19 years old, has been charged with two felonies: aggravated burglary, and assault with a weapon. She has also been charged with the following misdemeanors: unlawful restraint; partner/family member assault; and two counts of criminal mischief. There is no word yet on whether additional charges - such as sexual intercourse without consent - may be filed. It's disappointing she wasn't charged with rape/sexual assault and neither those were used to describe the incident. She isn't charged with any sexual related crime.
Yeah it is really disappointing, the article seems to imply it may happen later ("There is no word yet on whether additional charges - such as sexual intercourse without consent - may be filed") but either way it's ridiculous
From what I can see, there isn't actually anything in Montana's rape laws that would not have her charged with "sexual intercourse without consent (rape)". It's not actually a case of old fashioned gender definitions disqualifying it on a technicality, it's actually a case of the contemporary legal system displaying gender bias.

The victim does not decide the charges.
That just makes things worse if the authorities have completely failed to file rape/sexual assault charges.
Why is she doing a stereotypical white person face in her arrest photos.
They might just be weighing the fact that they already have enough to lock her up for a decade or more vs trying to also argue a case for those specific charges as well. There's only so much you can throw at a jury.
I'm a bit confused, the title has the woman's last name in the title as if it's important; am I supposed to know who this person is?

It can be hard to make a case with an uncooperative victim.
Based on her name I'm guessing she's somehow related to Ray Mears, a dude who used to present a survival show.
