An Anchorage man walked out of court a free man Wednesday after changing his plea in the case of a brazen midday assault in which charging documents say he offered a woman a
ride, then strangled her unconscious and masturbated on her.
An Anchorage grand jury indicted Justin Schneider, 34, on four felony charges including kidnapping and assault, and one misdemeanor count of Harassment I--offensive contact with
fluids -- for the August 2017 incident.
Schneider struck a deal with the state, pleading guilty to a single felony assault charge in exchange for a sentence of two years with one suspended. Schneider faces no additional jail
time. He received creditfor time served while wearing an ankle monitor and living with his family.
The license plate number, along with the victim's description of the man, led APD to Schneider, who had reportedly driven from the scene of the assault to his job at Ted Stevens
Anchorage International Airport, where he worked as a controller in the airport's tower. Anchorage Assistant District Attorney Andrew Grannik said Wednesday that Schneider lost his
job working for the federal government as a result of the case, a consequence he called a "life sentence."
Grannik said he agreed to the plea deal based on Schneider's enrollment and progress in a treatment program, and an expert's assessment that the risk of him re-offending is low.
"I hope it doesn't happen," Grannik said. "That's the reason why I made the deal that I've made, because I have reasonable expectations that it will not happen. But I would like the gentle
man to be on notice that that is his one pass -- it's not really a pass -- but given the conduct, one might consider that it is."
When given the opportunity to speak, Schneider offered no apology or recognition of the potential long-term impacts the assault might have had on his victim but highlighted the
positive effects the case has had on his own life. "I would just like to emphasize how grateful I am for this process," Schneider said. "It has given me a year to really work on myself and
become a better person, and a better husband, and a better father, and I'm very eager to continue that journey."
Judge Michael Corey accepted the deal, noting the outcome of the case could be described as "breathtaking." He said his decision was based on the prospect of rehabilitation.
"Mr. Schneider is going to be a member of our community, and he would not be in jail for the rest of his life even if he had been convicted on all of the counts for which he was charged,"
said Judge Corey. He also told Schneider, "This can never happen again."
Grannik said he attempted to reach the victim by phone to notify her about the hearing but was unsuccessful. He said had he needed to locate her for the purpose of a trial, he would
have needed the assistance of detectives.
When asked why Schneider was not required to register as a sex offender, Grannik explained that the conduct in the case did not meet the legal requirements of sexual assault charges,
even though the assault included sexual elements. As part of the plea deal, Schneider must spend three years on probation.

Devil's advocate- while he should be hit with a sex charge imo, if he's actually, genuinely being successfully rehabilitated, isn't this a step in the right direction for anyone who believes in rehabilitation as opposed to punitive practice?
People can't help being fucked in the head, what if he's finally getting help that would have prevented this in the first place?
Don't get me wrong, my gut tells me he should be thrown in the slammer.
If a single instance of the justice system failing is enough to say "rape culture!" then any single instance of a man being denied custody of his children unjustly is evidence of a misandrist culture.
I take it you are just ignoring the mock investigation of a supreme court nominee that actively avoided asking witnesses who said they personally knew the dude was a sexual predator.
Or the president saying he loves grabbing women by the pussy.
Or how the GOP backed, pulled, then backed again a potential child molester as a candidate.
Or the president saying the sexual assault allegations towards his nominee are all false and fake news.
I mean that's much better evidence of rape culture.

Two of those are words from an idiot and all are heavily political. I think its more likely that people in political positions use those powers to hide rather than there being the forbidden "rape culture".
I really wish a better term was picked for that though, its like oh in Australia our culture is to drink tinnies and have bbq's whats yours? Oh to just let men rape women.

I don’t expect this to be a popular opinion on here but if there really is a chance for rehabilitation in this case, putting him on the sex offender registry would completely ruin those chances just because of how archaic it is. The way we deal with sex offenses in this country (namely the registry itself) is so ass backwards and draconian, that it almost guarantees the likelihood of people reoffending. There is no really feasible way for anyone on that list to ever reintegrate into society as it prevents them from living in a huge number of places and prevents them from ever having a job willing to accommodate their restrictions, nevermind that every conversation they have must end or begin with “by the way I’m legally obligated to inform you I am a sex offender”.
Releasing them back into society whilst giving sex offenders nothing left to lose is a great way of creating more victims of sexual crimes. They probably had to take all of this into account when handling his sentencing, because the system is so broken that it creates repeat offenders.
Obviosly this guy is still a complete asshole not deserving of sympathy for the way he acted, but the guy did lose his job, was under house arrest and sentenced for time already served, and voluntarily enrolled into a treatment program as part of his sentencing. The title is misleading because he was sentenced for time already served while under house arrest as I already mentioned.
One of the few things I do agree with in parts of Europe is how sentencing guidelines are more focused towards making sure people don’t cause trouble once they are inevitably released back into society, instead of using our bullshit “tough on crime” approach which favors harsh sentencing, a private prison hellscape, and almost guaranteed reoffending rates.
In this rare case, I think the court took all of this into consideration and concluded it would be far better to reduce the likelihood of him reoffending at all instead of giving him a harsher 5 year sentence with no chance of rehabilitation and an increased likelihood of someone actually dying the next time he does offend.
When figureheads of the Government are perpetuating that victims are liars and attention seekers, its an underlying cultural problem that allows that to happen in the first place. Just look at all the people who backed both saying said women coming forward were whores and defiling the poor men. In the kav thread someone showed a comment from a woman who said women are such whiners and crazies for having the audacity to complain about being molested.
Being honest about choking a girl out then jizzing on her isn't the same as being honest about stealing some shit.
I believe in rehabilitation, and i hope that the expert and is right and he doesn't re-offend, but rehabilitation is usually a long and complicated process, and considering he was convicted just a little over a year ago, i'm a bit suspicious.
I don't know the man, though, so it's not right to jump to conclusions. Still, i can't help but worry.
