A Discord representative just replied with a pretty lengthy statement on the matter:

Dropped nitro
My understanding is that, generally, EULAs and stuff don't really carry much legal clout in this regard.
"we can't be as profitable if you can hold us accountable, dummy"
"whoopsie doodles OwO! Looks like we're in your base, removing your legal rights ¯\_(ツ)_/ ¯ LOL"
Maybe this is what they had in mind and it was a metaphor for their userbase all along?

I've always thought this was a typical ToS clause.
And then they get sued by Australia and EU
LMAO
So if you're in Europe, you don't really need to opt out because it's not legally binding here anyway, right?
Probably, but you're better off doing it anyways if you want to opt out.
That's correct, the EU law trumps this ToS clause.
hi, I'm your average consumer that likes the convenience but hate inviting more responsibilities to my life. Should I do anything?
Even if you think you would never actually sue Discord, you should still have the right to do so.
All it takes is 1 simple email and you'll opt out of this, you've got until November 22nd to decide.
Article 77 of the GDPR ("Right to lodge a complaint with a supervisory authority") actually makes this invalid in the EU.#
And a bunch of other EU laws or even country level laws make ToS invalid most of the times.
In the US it seems very much applicable though if you can trust the OP post on reddit.
the American legal system really is fucked, and I say this as somebody who lives in a country where everyone who's a qualified barrister has to wear a powdered wig in court
and you ask why I refuse to use discord
sheesh, this is getting there
Why can't gamers just get a simple chat app without it revoking your rights or installing malware / being detected as a game cheat?
Because most people are dicks.
If I could drop discord, I would. This just makes me wish I was able to more.
I can't wait for discord to be replaced by new chat service #13532 in the next few years, I won't miss it at all.
Already despise Discord before this? Won't this just end up in a vicious cycle of hating popular things?
I don't think there's a court on the planet where this is actually capable of holding water better than a strainer, even in the US. Don't have any particular examples in mind but iirc there's been a lot of incidences in the US regarding retarded TOS where the courts have gone "lol no".
Is Discord down for anybody else?
Tech companies is the same.

Another example of US consumer laws being shit, this doesn't standup in Europe and most Oceania countries.
Regardless of what the EULA or TOS states, we can sue them as a consumer if the need is there.
Pretty sure the courts would throw this out, as they have done previously with other ToS.
Doesn't make this less fucked up / an abuse of our shitty consumer laws though.
Everyone who uses Discord (in the US,) should be emailing them.
Probably worth opting out so you retain your right to take legal action if you're in the UK considering we have no fucking idea what the Tories are doing with Brexit and which legislation will be carried over if we really do commit national suicide.
