A lot of smaller non-EU sites can't actually comply with the GDPR in full for one reason or another. Its not even out of malice or abusing personal information, its just not feasible for them. My job deals heavily with compliance, so things like the U.S.'s HIPAA and the EU's GDPR and plenty of other state, federal, and international regulations are my day-to-day. We've spent the last few months fighting with our German branch because they want to interpret GDPR in a way which would basically prevent us from doing almost anything to effectively manage their IT infrastructure and actually makes them more insecure than if we can have our way. But it seems to be from the people we've talked to is that in fact our interpretation of GDPR is the correct one and they can go fuck themselves, we're taking full control over their infrastructure.
Corporate compliance is a nightmare of documentation and conflicting regulations. For a place like this, noncompliance with GDPR is likely the only viable route for them.

Technically it is battery because the one they did it to, and everyone else involved, has no way to know what was actually in it. Basically they and anyone else around could be introduced to any number of dangerous substances that have been added to it if there are any.
