The Trump administration and internet service providers had asked to justices to wipe away the ruling by the U.S. Court of Appeals for the District of Columbia Circuit that had temporarily preserved the net
neutrality regulations championed by Democratic former President Barack Obama. But the justices refused to hear the appeals, leaving the lower court ruling in place.
Seems okay? Based on the fact that Roberts and Kav recused it would have gone 4/3 for net neutrality, but the thing is only four of the nine justices can want to do a case to permit it, so the four liberal ones
could have permitted the case on their own, so one or more of them didn't.
One assumes that the FCC under Pai will simply not enforce net neutrality despite this ruling. Maybe have a one man office with a $10 annual budget to enforce compliance as a token gesture.
At least with the EPA courts have ruled that the agencies have a duty to the things they have to, and if Democrats take the House, the House originates all tax and budget bills. So if Pai doesn't want to enforce
NN he pretty much needs to resign.
This means they're under a court obligation to restore NN right? I'm betting this is going to go the way of marriage licenses for gays and equal rights.
No.
This is a case from the Obama era, ISPs suing the government over those NN rules, that just took a while to get through appeals. The rulings of the lower courts was "these rules are/were legal", by not taking this case the Supreme Court effectively ruled that the Obama-era net neutrality rules were constitutional. This does not make the rules suddenly take effect again, but it does mean the FCC can re-impose those rules or similar at any time - basically, whoever replaces Trump in 2020 shouldn't have any problem re-instituting net neutrality. I'm sure ISPs will sue anyways but lower courts will see the Circuit Court ruling, and should reject it accordingly.
Fuck
