Attorney General Matthew Whitaker is consulting with ethics officials regarding possible recusal from overseeing the special counsel’s Russia investigation, the Justice Department
said on Monday.
“Acting Attorney General Matt Whitaker is fully committed to following all appropriate processes and procedures at the Department of Justice, including consulting with senior ethics
officials on his oversight responsibilities and matters that may warrant recusal,” Kerri Kupec, a department spokeswoman, said in a statement on Monday night.
Whitaker has been overseeing special counsel Robert Mueller’s investigation since last Wednesday, when Attorney General Jeff Sessions’ resignation triggered a set of events that left
Whitaker, Sessions’ chief of staff, in charge of the inquiry instead of Deputy Attorney General Rod Rosenstein.
Democrats have sharply criticized Whitaker over his numerous past statements questioning Mueller’s investigation, including suggestions that a possible Sessions replacement could
slash the special counsel’s budget so low that any further efforts would cease. White House counselor Kellyanne Conway stressed on “Fox News Sunday” that Whitaker had made the
comments as “a private citizen” before joining the administration and when the investigation was just beginning.
Whitaker, a former U.S. attorney and frequent Republican candidate for political office in Iowa, also has a relationship with a former Trump campaign official, Sam Clovis. Whitaker
served as chairman of Clovis’ unsuccessful campaign for Iowa state treasurer.
Clovis, who served as co-chairman and policy adviser on the Trump campaign, is reportedly a key figure in answering questions about whether members of the Trump team conspired
with Russian officials during the campaign. President Donald Trump nominated Clovis to a top post in the Agriculture Department, but Clovis withdrew amid staunch criticism about
his views and his connections to the Mueller investigation.
Rep. Jerrold Nadler (D-N.Y.), who is expected to lead the powerful House Judiciary Committee when Democrats take charge of the chamber in January, said on Monday in response to
Whitaker’s statement that he doubted that the acting attorney general would surrender supervisory duties over Mueller.
“He’s obviously not going to recuse himself. He should recuse himself because he’s prejudged the issue,” Nadler said in an interview on CNN, adding that the Judiciary Committee’s first
order of business in the new year would be to call Whitaker to testify before the panel.

I can't tell whether this is to make it look like it wasn't his decision to recuse himself or to justify not recusing himself.
Here's a good question I've not yet seen asked, let alone answered: if you randomly picked a Republican politician/bureaucrat of a rank that could feasibly fill the job, what are the odds that person would have to recuse due to conflict of interest or potentially being a target of the investigation? I have no idea how to even start crunching those numbers, but I'd wager it's over 50%.
After hearing a bunch of stupid "SESSIONS SHOULDN'T HAVE TAKEN THE JOB IF HE KNEW HE'D HAVE TO RECUSE" arguments, this will be absolutely delicious.
For all the horrible shit Whitaker has said, if he chooses to recuse himself he'll prove himself to have more integrity than the man who appointed him.
If that happens, I REALLY want to be a fly on the wall when Trump gets told.
Best case scenario i think would be anyone trump puts in that seat also realizes they should recuse themselves and just let Rosenstien own it. I know this might not be realistic, but i'd like to think that the new AG gets placed, starts reviewing whatever in the Mueller case he's privy to, then realizes its not BS and needs to recuse. It seems like its a win win for everyone too because just devils advocate if the Mueller investigation ends up going in a totally different way than we'd expect and its not really malicious purposeful involvement on the side of the trump campaign then Rod takes the 'blame' for it all.

Good, but really he should be consulting ethics officials about resigning his illegally given Attorney General title.
One can hope anyone appointed AG realizes the minefield taking negative action against the investigation is but I have doubts as to how much they would give a shit.
What if he's already been able to do sufficient damage (perhaps by leaking documents to Trump) and recusing himself is a way to cover it
He may not be able to shut down the investigation but at least they'd have a ton of information (which is extremely valuable)
From everything that's been reported, it might be too late for that. If they'd learned who was being investigated for what earlier on, they might have been able to coordinate their stories, keep anyone from implicating Donny or his core group, but if Mueller really is planning to finish up in the next few months, it's probably too late. He's got the evidence, now he's just collating it. And probably waiting for the next Congress to be sworn in, this isn't something to hand a lame duck.
