While minor bugs and glitches are expected with the release of most new games, Fallout 76 launched with a 56GB patch that has proven to be but a starting point for the game’s problems. Gamers who have tried to receive a refund because of the game’s myriad glitches have been unable to do so since they downloaded the game, leaving them to deal with an unplayable experience until patches bring it back to a playable state. The most abhorrent thing about Fallout 76 is not the low quality of the game, but Bethesda's lowering of the price so substantially over the course of a few weeks. That coupled with the inability for the folks who bought it at full price upon release not being able to get a refund. I'd be pissed off.
If this was in Europe I'd expect it to go somewhere but this being an American lawsuit leaves me a bit skeptical.
It's not "literally unplayable" come on now
This is a little fucking ridiculous. Yeah, it's buggy server side but not to the point of a law-suit. Most of the people I've seen on PC bitching about how the game is "literally unplayable" are people running old ass mobos and GTX 780s who have never updated their drivers getting 10fps.
I actually want to play fallout 76, but that price vs the content it provides? notify me when its hit like 15 bucks.

Yeah I don't get why people don't understand this. They didn't launch on Steam because they knew it would get horrible public reviews and refunded.

Bethesda Support offered refunds, but it turned out they retracted after sending another email saying the refund was void because they downloaded the game.
called it using their own launcher solely to keep people from refunding their game was visible from miles away go fuck yourself bethesda-zenimax
Idk, a >50gb patch right out the bat would make it pretty unplayable for me due to third world internet and not having 100gb to spare for a videogame that lists nowhere near that in their minimum required specs. At the very least they should issue refunds for people who have no way of playing the game they paid for.
I wonder how their "open letter" about how buggy the "beta" is going to play into this.
50+ GB patch that redownloads nearly the entire game just to add about 300MB of actual data changes. For a small hotfix.
The idea that a company can circumvent refunds by utilizing their own game launcher or DRM service is ridiculous. Companies need to stop this shit and stop releasing games that are train wrecks on release. I'm really sick of this "Buy the game now, and play it a year later when it is finally fixed." If your development cycle doesn't have enough time to insure a product is released in a satisfactory condition then maybe your development cycle is to fucking short. Way to completely miss the point of all this. Also btw, a lot of people who have solid rigs are having issues running the game. So stop sounding like a fanboy because you are coming off as one.
I have not heard that from anyone the people I know that got refunds, they got their money back after playing maybe 3 or so hours?
I only got my money back because I refunded after the BETA so it was still technically a pre-ordered and not sent. I'm lucky I guess.

I'd be willing to bet they make an exception to Australian buyers due to our consumer law enforcing refund practice. If they are refusing they are in for a shock.
That is a shitty policy and should be illegal. But still, I heard people get refunds without a problem. Tho, since they have that policy, I do hope that this lawsuit fixes that.
Jesus I never thought I'd see something backfire so hard on Bethesda. Figured people were gonna let them get away with this just like everything else. Hopefully this will set an example for other publishers, reminding them that consumers have power.
To be fair a GTX 780 should 100% be able to run the game
I know that Bethesda is in the US, but in the EU that actually is what the law says they should do - you downloaded the game, you can't get a refund anymore (although it isn't entirely clear what to do in the case of a game not working specifically) . Refund policies like what EA or Steam do actually go beyond what they're legally obligated to have.
That sound increadibly unreasonable, thats like buying a product in a store, opening the package and seeing that the thing you bought is smashed to smithereens and you cant get a refund because you opened the box
Steam has the obligation to do so under Australian consumer law. They are appeasing AUS with the refund service, it is not them wanting to go above and beyond.

Under that sort of situation the "you downloaded it so no refund" would be complying with EU law.

Expecting Bethesda games to not be raging dumpster fires at release is what I would consider the definition of "delusional", so if anything people are getting exactly what should be expected. Trash.
