Wait, so, they realize it leaves open possible violations of due process, but just went “eh, we’ll reverse it after it’s happened a couple of times”!?
The case wasn't about the law itself, the dissent questioned the intent of the law but the majority only wrote to make it so that the immigrants can be detained at any time.

If and when a Democratic president gets elected, they will have a moral obligation to pack the courts with liberal judges. Enough already.
The article said this only applies to people who were convicted of certain crimes but it doesn’t seem to really specify which crimes those are. So does this only apply to felonies, or is this basically just an excuse to find any little thing to punish people with retroactively?
Also I thought most violent felony charges were already supposed to fast track people to deportation?
Its about legal immigrants who commit crimes where the punishment is deportation. After they serve jail time they can be indefinitely detained awaiting deportation.
Ah, thanks for clearing that up. So I’m guessing this would basically this deny people of bail pending the immigration hearing while giving them an ultimatum of “leave voluntarily or wait in jail for a decade to have legal representation”?
If so then yeah that’s pretty terrible.
