I have seen servers selling in game items is this legit?
I have not been able to find the rules if there are any can someone link this if it is a rule violation?

Absolutely they can, they are called "Donations". You can buy and sell skins and bags on Steam ,can you not? There is no difference.
On a side note, Server owners can practically do nearly anything they want. And believe me ,one needs to firmly grasp and understand this. This isn't a debate, (although many have attempted over the years) it is pure fact.

while I do think it's sort of shady to sell out your server to the highest bidder I can see the appeal for server owners to pay the bills. Many other game developers have EULAs in place strictly forbidding this practice. This is why I asked.
I can see it being good and also bad as well.
Keep in mind that if you send a "Donation", you are not really eligible for any consumer protection that you would get from a "Purchase". Though it's usually done that way to avoid all the complications of tax paperwork on the host side and it's entirely understandable in 99,9% of cases.
Regardless, before you "donate" (or even make a proper purchase), make sure that server you're dealing with is reputable. That's frankly the one thing that will keep you from being screwed over. If you don't agree with the practices of a particular server, the best course of action is to either not give them any money or find a different server.
