Whoever set that date is a pedo.
Usually i chalk up defamation shit as 'just find your own middle finger and use it', but him calling someone a pedophile because they were annoyed that he was using a crisis situation as a publicity-stunt is really something i wouldn't mind him getting a smack across the fingers for.
He should call the judge a pedo for disagreeing with him and it'll be like Inception where the stakes are raised as he descends into recursive, Russian doll universes of accusations.
This case is going to be closed very quickly because defamation must fit these four criteria: published false injurious unprivileged All of those are applicable except "injurious". The statement must be "injurious." Since the whole point of defamation law is to take care of injuries to reputation, those suing for defamation must show how their reputations were hurt by the false statement -- for example, the person lost work; was shunned by neighbors, friends, or family members; or was harassed by the press. Someone who already had a terrible reputation most likely won't collect much in a defamation suit. I seriously fucking doubt the diver lost anything by Musk calling him a pedophile. At worst it put a doubt in some people's minds, but nobody just straight up believed him aside from hardcore Musk fans who are already so far up on his nuts they should be considered a medicating powder by now. Nothings going to come of this. It's just once again two egotists butting heads, this time trying to use the law instead of calling each other names on twitter.
I know youre making a point here but "so far up on his nuts they should be considered a medicating powder" is going right in my dictionary.
But consider this, Musk has massive influence. Imagine if you got called a fucking pedo by Elon Musk of all people. People who support musk could, let's say they are massive fans, doxx you, send death threats to you and your family, potentially. The possible ramifications are big. I would consider this bullying.
Being called a pedo and/or a rapist are one of those accusations where in the court of public opinion it doesn't actually matter if you did it or not, so yes, it was absolutely injurious.

While I understand that it was inthe end a publicity stunt (and i'm not defending musk's actions), it was not a worthless one, the machine he built was built to the specifications the diving team wanted, so he probably called him a pedophile in an anger fit because of someone calling the creation (his own team requested) worthless. Again I'm not justifying the actions of elon, he could have just used a normal insult, but the diver is also a cunt.

He didn't call out elon because the submarine thing was a stunt, he called the submarine useless, even though it was the divers who laid out the specifications it was built to.
He should call the security guards pedo as well as the lawyer defending him and suing him And then it turns out that they're all legally confirmed pedos Elon was right all along
Considering the judge refused to dismiss the case you're probably wrong on this one.

Every time I see some variant of this and they make no effort to change that last panel whatsoever, that always gets me.
in the realm of law "possible ramifications" don't typically qualify as injuries. Not sure if there's anything within defamation law that changes that. Generally, you need to be able to point to something concrete in order to get any kind of money damages. Don't know the details here so don't know whether this diver does have a cognizable injury.
