I'm pretty sure it's your pivot acting up. I usually fix this by selecting the object, hitting "Reset Pivot" under the Hierarchy tab and then selecting the mesh via vertices and placing it correctly.
1. make and assign a bone in the reference.
2. make the same bone (name/position/angles) on the physics model.
3. recompile
that should fix your problem.
@Fewes, I can reset it but explain the "Select Mesh Via Vertices and Placing it Correctly.
@Naelstrom, I'll have a go but i don't know how to do it so i'll have a good educated try.
-No i can't work out the bone thing in 3DS Max 2010.

Select the mesh, go to edit vertices mode, select all vertices and position your model.
