The Florida man who claimed his girlfriend choked to death during oral sex was found not guilty Monday of second-degree murder.
Richard Patterson, 65, of Margate, was acquitted of killing 60-year-old girlfriend Francisca Marquinez in 2015 after a week-long trial, accoring to the Sun Sentinel.
During the trial, his lawyers initially argued that Marquinez died accidentally while performing oral sex on him at her apartment.
To bolster their defense, Patterson’s lawyers filed a motion to show his penis to the jury.
But after a medical expert testified that choking during the sex act was unlikely, the defense reversed course on the theory. The judge never ruled on the request to put Patterson’s member on display in court.

Instead, the defense argued that there was no way of knowing how she died. Medical examiners never determined the cause of death because Marquinez’s body was too decomposed.
“They still don’t know how she died,” said Padowitz, according to the Sun Sentinel.
Wait, how long did he take to report her death if she was "too decomposed" to determine cause of death?
Couldn't they just measure and check against her windpipe? also if it was true wouldn't you notice that your partner is choking?
also, they could charge him with assault with a deadly weapon as they've done the same with those whom are infected with STDs.
Does the logic go something like this:
Small objects are choking hazards.
I have a large object.
Ergo, I am not a choking hazard.
Q.E.The D.
I fail to see the logic in this to be honest.
Medical examiners never determined the cause of death because Marquinez’s body was too decomposed.
???
Did he not get her to the hospital or report her death or something? If he was storing/hiding the body that seems like a conviction for hiding a corpse at minimum, even if the murder itself cant be established.
To bolster their defense, Patterson’s lawyers filed a motion to show his penis to the jury.
Imagine being either the lawyers who had to file that motion, the jury members who received it or the journalist who had to write that sentence.
How the hell do you put someone on trial for murder without knowing how the victim died?!
Her body was fucking decomposed. Accidental deaths don't go unreported....
How the hell do you put someone on trial for murder without knowing how the victim died?!
I live near margare - and this doesn't really surprise me they charged him. And apparently he let her body decompose for 2 days without calling the police about her death so that probably made them much more willing to charge him. Cause that is pretty damn sketchy, pretty much as sketchy as it gets

Well that sure as hell is a good reason, but in that case the whole penis defense seems moot, since he failed to call for help which in itself is already a crime. How did he not get convicted then?

I'm not sure

In the US there is no duty of care between boyfriend and girlfriend. Only a limited duty between spouses. You can see someone dying on the side of the road and you aren't liable to help them at all.
Since no evidence was presented on how he killed her (if he did at all) there can be no murder conviction because they didn't establish causation. It may have been possible to get him on some obscure improper disposal of a corpse charge but I would be surprised if that stuck; historically you have to have some ulterior motive and I doubt they could prove it if they couldn't even figure out how she died.

Wow, this sounds pretty dystopian to me.
Over here you'll get sued to hell and back if you don't even call an ambulance
So how big is his dick?

Chokeworthy
I was imagining this:
According to the warrant, Patterson texted his daughter in the afternoon on Oct. 28 and said, "Your dad did something really bad last night and I'm so so sorry." His daughter told detectives that she had a brief telephone conversation with her father, at which time he told her that he, "couldn't go on" and said goodbye.
A text to a family friend read, "My meds are making me crazy and I can't function." The friend told detectives that Patterson later admitted to her that he had choked Marquinez to death.
So he [accidentally] killed her, fled the scene to lawyer up, and finally his lawyer called the police to retrieve the body.

So no surprise that the Post article is basically useless?
I wonder if he got off on insanity. That sounds pretty straightforward to me, you'd have to really fuck up as a prosecutor to lose a case like that.

If they charged him with murder, it makes sense that he wasn't convicted. This doesn't look like murder.

it seems like he wasn't convicted for second degree murder specifically
there's still a bunch of other shit he's going to be hit with
I'm surprised this guy got off.
Chokeworthy
Yeah but you can choke on a 4 inch dick so that's not really enough information to by, joke or not.
If it was like a 9 inch dick and quite thick then yeah, balls deep on that fucker, small mouth or no, you'd be choking anyone.

Double jeopardy prevents that

Could have come back with a manslaughter verdict unless they royally fucked up the jury instructions. Something doesn't make sense here.
Also double jeopardy doesn't work like that.
I didn't know super deep throat got an update.
In some states, you can be sued if you try to help someone, but end up making it worse.
I forget the term, but more and more states are making it easier for civilians to help each other, even if they fuck up and make it worse.
Good Samaritan laws. They basically afford protection to people who make a genuine effort to help someone that is at risk of injury or death. I believe it covers things like overdoses to what I can only explain using this clip from the Incredibles:
