Sounds like a correct use of the hate crime statutes. I just wish they were applied consistently, though I guess that is the inherent risk when you make the standard as subjective as "hate."

I thought the US were generally pretty lax with prosecuting hate crime.

Compared to Europe? Yes, the US is very lax. I'm more talking about the consistency of it's application, not the strength of it's application.
