I don't see the problem? Maybe I don't know enough about Youtube monetization to make a clear call but it reaches a compromise for whatever the hell Nintendo is going for here. I think it's dumb they're putting their foot down and require some more explanation as to why but at least they're not outright banning people in this program from livestreams.

Why would you even need to be in nintendo's program? people think it's mandatory but it isn't, you can be outside nintendo's shitty practices and still stream your game.

This is probably a response to the Pewdiepie incident, where they don't want the next Pewdiepie-style steaming incident to be potentially be attached to a Nintendo game.

I love Nintendo to death but these anti-consumer practices need to die down or just stop all together, and the way to do that is make their legal team simmer down which I can't see happening any time soon.

If they're smart (relatively speaking), they're only doing this because they plan on releasing some sort of recording functionalities or Twitch integration to the Switch very soon and will be updating the terms once that happens.
But given how the Creators Program has been, and the reactions to it, it's likely they're just shooting themselves in the foot. They should really take a note from other companies and have a more hands-off approach towards content creators, and maybe even encourage some of their own employees to do some more frequent game-streaming of their own.

I wouldn't be surprised if video capture on the Switch is being delayed because of conflict between R&D and Legal, seems like a big area where they would clash

The creator program is just nintendo as a publisher exerting control upon mostly the very people who praise or care about nintendo so much. Videos of Fans playing Fan Games taken down to protect their IP for example.Content creators who have previously been able to post Nintendo videos and have fanbases around that have less flexibility in how they monetise them through their partners now that they are completely fucked unless they go through nintendo. It's less viable to make a living if you are exclusively making pokemon videos or mario videos on rom hacks or anything that runs under Nintendo IP.
The fact that you are recording/streaming on their content should have nothing to do with it, Nintendo forget that alot of these people sell their game for them to a degree. I know i've been tempted to get BOTW and a Switch after watching a couple of my subscribed channels played them. Not only that, alot of those channels bought a switch, they paid for a copy of the game. Nintendo got their cut infact Nintendo ought to be paying content creators, they ought to be hiring these people who have genuine passion of their games to the point where they make complete remakes. Instead they opt for the nuclear method.
Publishers like Microsoft,Activision and EA know that these people sell the games, it's why when we hear of a Battlefield 1 reveal or a Call of Duty reveal, any form of gameplay reveal that these youtube personalities are attached to the game and they get as many of them as they can. These youtubers with hundreds of thousands to millions of subscribers.
It's pure overkill what nintendo have done but it doesn't surprise me after the stuff i've heard about the Metroid 2 remake. They are punishing the very people who they should be praising for their creativity.

Playing a game which intrinsically involves interaction is a bit different to watching someone play a video game.
If your game is vapid to the point where that's the case then you haven't made a game, you've made a movie.

That's basically it. Nintendo games are apparently not good or innovative ("You're still fucking jumping on coins after 30 years!"), and kiddy franchises like Mario would have been put out to the woodshed 15 years ago if it wasn't for all of Nintendo's manbaby fans who want to forever be reminded of when they were six years old and played Super Mario World in their little Mario jammies. Also, they need to get laid.

This has nothing to do with nostalgia gaming. The developers behind games as Zelda and Mario don't have anything to do with the business decisions done by lawyers and the other corporate guys at Nintendo that have a very outdated way of protecting their IPs.
The devs developing their games develop the games and that's all. Why do you expect me to NOT buy the games and support the devs work? Because shit is hitting the fan somewhere else where the dev teams can't do much as it's not their working field?
Should I stop using Steam just because Valve has become lazy as fuck when it comes to developing games? Or that they get a 30% cut, let Steam being flooded with shit games and make so many bad decisions concerning their games?

I've watched gameplay videos from three games pretty much: MW2 (yeah I know), FO3 and Dota 2. Those are also the games I've played the most.
Maybe some people watch gameplay vids as a replacement, but I'm gonna say it's much more likely that people watch videos of games they're interested in - games they play themselves.
