Honestly, I don't believe anyone owns the copyright. The photographer didn't setup the shot or anything. And the monkey has no interest in holding a copyright. PETA's objective appears to be money.

Peta sued on behalf of the monkey. After the original photogropher who set up the camera claimed the image as his after wikipedia put it up under creative commons.
The dude's supposedly ruined too. Stupidly in debt to pay lawyer costs. Which means peta has decided that the life of a guy is worth less than the property rights of a monkey, which lacks the capacity to understand property rights, or even what a photo is in the first place.
