Watching Fox News right now, they said the driver is in custody (CNN isn't showing it yet) The car is wedged right on top of metal bollards, but they're saying that it's plausible this is a major traffic accident and not act of terror.
What I've been hearing too is that it is more likely that driver lost control of vehicle. Either way I can see there being knee-jerk reaction.

It's a sad state of affairs when you have to be suspicious of an event like this. I feel even 5 years ago, no one even would have considered this to be a terrorist attack when it very well might have been a complete accident.

The traffic in the downtown area is just so intense, especially around noon time right now, that I would think it impossible for him to go any faster than 30mph (which for hitting a person is still quite fast but I not anything like France or Germany's attacks).

If say I was piss drunk and drove home and killed someone in the process it wouldn't matter if I was driving down Broadway or 12th. I still equally broke the law and didn't care which way I was driving to get home. Point is unless he intentionally went through Times Square to cause an accident then sure, charge him for intending to do harm. Otherwise this accident is no different if it had happened three blocks away.
