End user license agreements are stupid. I would legitimately read an agreement that was totally honest and human-readable, and not some legal pile of waste.
Man, iTunes is such a terrorist program.

An Act of God is a term used widely for things outside of the control of any of the parties participating in the agreement or contract.
It's seen a lot in insurance.
Pretty late. Those exact phrases have existed since the original version of iTunes, and was brought out long ago.
At least they're playing it safe.
