My brother is arguing that it's not an FPS because "just because you can go into a 1st person view and shoot a gun it doesn't make it an fps. It doesn't have the proper feel of recoil and it has melee / VATS system, whereas FPS focuses on first person view and focuses on how a gun would properly feel and act"

You shoot in first person.

Your brother needs to take some lesson in not being stupid, what the hell does he play? The only FPSes I can think of that a re 1st person all the time are far cry2 and the half-life and portal games. Does he play Halo? because even in that you go in third person for teh vehicles and cutscenes.
