It's not about that. Gearbox is the rightful owner of the IP now. 3D Realms even [i]admitted[/i] that Mass Destruction is an infringement and they apologized.

...and then continued with release plans anyway. Gearbox didn't have much choice left. You can't just not protect your IPs, otherwise everyone will start walking all over you and making money off of a name that you own.
