This bit from the last two paragraphs seem to be summing up the analysis pretty succinctly:
McArthur foresees a similar outcome, stating that "the biggest impact here will be that it sends a message to other game companies to be careful about what they put in their trailers and not to oversell their games with unrealistic 'gameplay footage.'" After restating his belief that Hello Games has neither broken the law nor purposely deceived any of its players, Morrison closes with a piece of advice it's always worth reiterating: "People need to stop pre-ordering games."
And before people start arguing about the bolded part, I'd like to mention that the lawyer-consulting article does examine both the trailer footage and the comments the devs made, and it also compares it to similar old cases like Aliens: Colonial Marines.
That's about as truthful as hillary's email investigation.

The only thing a lawyer is qualified to state anything about is whether the evidence is damning enough for a favorable ruling, which often, especially in an untouched area of law like video game false advertising, requires a huge burden of evidence far in excess of what any reasonable person would decide is clearly lying to customers.
Videos and screenshots depict the ideal planets, the ideal wildlife, the ideal experience--and that's not necessarily what everyone's going to get
But that's what less than half of the complaints are about. Missing game mechanics and other features. It's not only about what the animals look like or the density [editline]30th September 2016[/editline] The lawyers did no research
Aliens: Colonial Marines.
but A:CM was a success??? randy pitchford said that himself so it much be true!
