This is breaking right now so no one has a story yet. NY1 has it as a headline for their story. OP Update
(Reuters) - A New York grand jury has decided not to charge a police officer who killed an unarmed black man with a chokehold while trying to arrest him for illegally selling cigarettes, a lawyer for the victim's family said on Wednesday. The city's medical examiner ruled the death a homicide. The New York Police Department's patrol manual bans chokeholds, calling them dangerous. Civil rights lawyer Jonathan Moore, who represents the Garner family, said he was told that no indictment would be brought against the white police officer, Daniel Pantaleo, who placed Garner in a chokehold. The grand jury had been reviewing the Garner case since August, and Pantaleo had testified before it for two hours on Nov. 21, according to his attorney. http://www.reuters.com/article/2014/12/03/us-usa-new-york-chokehold-idUSKCN0JH2BI20141203

A grand jury in New York on Wednesday decided not to indict white police officer Daniel Pantaleo in the July choke hold death of Eric Garner, an unarmed black man, according to two law enforcement officials. During the fatal encounter July 17 Garner raised both hands in the air and told the officers not to touch him. Seconds later, a video shows an officer behind Garner grab him in a choke hold and pull him to the sidewalk, rolling him onto his stomach. "I can't breathe! I can't breathe!" Garner said repeatedly, his cries muffled into the pavement. The grand jury was made up of 14 white and nine nonwhite members. The cause of Garner's death was "compression of neck (choke hold), compression of chest and prone positioning during physical restraint by police," the medical examiner's office has said. The death was ruled a homicide. http://www.cnn.com/2014/12/03/justice/new-york-grand-jury-chokehold/index.html?hpt=hp_t1

The grand jury of 15 whites and 8 minorities concluded there was not enough evidence to charge the officer with a crime, although he could still face departmental charges. Pantaleo was stripped of his gun and badge following his death, DNAInfo.com reported. The article pointed out that the medical examiner ruled his death a homicide by chokehold, with asthma, diabetes and obesity contributing factors. Garner's family has filed a notice that it plans to sue the city for $75 million on the grounds of wrongful death, pre-death pain and suffering and civil rights violation, The New York Post reported. Rev. Al Sharpton, who is an advisor for the family, has called on a federal probe. Jonathan Moore, an attorney for the victim's family, said he is "astonished by the decision." What the fuck.
I'm curious to see more sources on this, I can't really get the full story on either of these sources.

Hopefully race can be left out of this to focus more on a corrupt system of law enforcement related political injustice.
Now this people should be mad about. There's fucking video evidence of the officer putting the man in the choke hold and he still gets off?
Complete bullshit but I'm honestly not surprised.
Okay, now people have a reason to protest.
I'm away from my computer, but Reuters has an article up and CNN updated theirs. FoxNews has one published as well.
That's literal bullshit. It's there in the video. He put him in a blood choke, and a very shitty one at that. That constitutes lethal force in a lot of places, and it was in a situation that did not warrant that at all.
Seems like a wait out for the Ferguson decision and for the Riots to die down. This one I can't side with the officer. This is bullshit
BBC too
Hopefully race can be left out of this to focus more on a corrupt system of law enforcement related political injustice.
It will be left out so long as the news media wants to report a story and not stir up controversy for more views
It will be left out so long as the news media wants to report a story and not stir up controversy for more views
Al Sharpton is the family adviser. Race will be brought up.
In a choke for about 18 seconds and he died? Isn't that sort of really unusual?
This is bullshit. The NYPD doesn't allow chokeholds, the officer used a chokehold, a guy fucking DIES because of it, and they just let him go. Absolutely fucking ridiculous
In a choke for about 18 seconds and he died? Isn't that sort of really unusual?
He was asthmatic, he started to get shortness of breath and the officers didn't respond to his pleas for help.
chokeholds dont work like they do in movies or games, getting knocked out from a chokehold can very easily cause your brain to get fucked up or kill you outright
No I know how quickly you can die from anoxia and how you don't just wake up 2 hours later feeling groggy like in the movies, I'm just surprised it happened much quicker than I am used to. But considering as one user pointed out that he was potentially have an asthma attack, I understand now.
They pretty much never indict them if they can get away with them. This was the problem all along.
I'm glad to know that you can straight-up strangle a person to death in public and not face any consequences for it. At least impersonating a cop is illegal.
alright none of the ambiguity surrounding the mike brown case, i can't see any possible other interpretation for this besides just choking him to death in cold blood
this really grinds my gears
Wrong on every level.
alright none of the ambiguity surrounding the mike brown case, i can't see any possible other interpretation for this besides just choking him to death in cold blood
That was my problem with the Brown case. And medias with conflicting evidence and statements didn't help at all. But this one is straight up brutal and unfair.
The outrageous thing about this is that the cop clearly performed an illegal action and choked an innocent man to death on video and he didn't receive any punishment. Not even a "hey pal, you're not supposed to strangle the citizens you're payed to protect". They just let him get away with murder, plain and simple. There's no debate in this one.
I'm not defending this guy because hes fucked to mars and back, but to be clear, because something is against policy does not make it illegal. I'm not a lawyer nor do I know NY law so I'll leave that to whomever has knowledge. This guy most-likely wont be a cop again solely because of the breach of policy and his already pending law suit about civil rights [editline]3rd December 2014[/editline] Also if you need a reason to be outraged, be outraged at the jury. They're the ones who let this dude go free (criminally)
Who was the jury made up of?
Who was the jury made up of?
Says it in the article... The grand jury was made up of 14 white and nine nonwhite members.
Says it in the article... The grand jury was made up of 14 white and nine nonwhite members.
I meant professions sorry.
Says it in the article... The grand jury was made up of 14 white and nine nonwhite members.
The obvious follow-up to that is: How many votes are needed to make a majority decision? If it's 14 or something then we've got another reason to be mad.
