Jessie Thornton sleeps during the day and runs errands and works out during the night."My wife, she's an ER nurse and works three 12-hour shifts, so I adjusted my schedule to be like her schedule," said Thornton.
The 64-year-old retired firefighter moved to a Surprise retirement community from Ohio.
Jessie says his late hours have put him in the police spotlight.
"I've been stopped 10 times in Surprise and given four tickets, it's amazing," said Thornton.
His latest incident with Surprise police officers prompted Thornton to hire a lawyer with plans to sue the department.
Around 11 p.m. Thornton, according to Surprise Police Department paperwork, was pulled over for crossing the white line in his lane.
"He (the officer) walked up and he said 'I can tell you're driving DUI by looking in your eyes,'" said Thornton.
The 64-year-old says his eyes could have been red because he had just left LA Fitness where he was in the pool swimming.

Sensationalist title, he wasn't charged with DUI, he was just handcuffed and taken in.
While that is shitty/going too far that's a completely different ballpark from being charged.
He was charged with a DUI, I watched the News broadcast today and it showed the police report which said he was charged with a DUI and had the MVD notified and had his license suspended
Jessie's car had been impounded and the MVD notified of the DUI charge.

Don't your cops have breath analysers?
He's been stopped 10 times and given 4 tickets. Something tells me race isn't the only factor.
He's been stopped 10 times and given 4 tickets. Something tells me race isn't the only factor.
what is the other factor
"Yes, I do the breathalyzer and it comes back zero, zero, zero," said Thornton.
While in custody, a "DRE" or drug recognition expert is called to test Thornton.
"After he did all the tests, he says, 'I would never have arrested you, you show no signs of impairment,'" said Thornton.
The Surprise resident is right. The police documents show the drug recognition officer wrote, "I conducted an evaluation of Jessie, in my opinion Jessie was not under the influence of drugs or alcohol."
According the documents from the Surprise Police Department, the blood analysis showed no drugs were detected in Thornton's blood.
Someone REALLY fucked up if the PBT, DRE, and analysis says hes fine. Only guilty of being a shitty driver
what is the other factor
shitty driving?
Essentially to use the race card in this you would need two things.
count of blacks in the community who are active drivers. The amount of tickets and stops they get. As it stands, you just have one guy who gets stopped a lot who happens to be black. I'm not saying race might not be an issue, but it might very well be a noissue and the guy might just be a really bad driver.
what is the other factor
being an awful driver maybe?
[editline]e[/editline]
damn you
what is the other factor
Negligence for the rules of the road.
He's been stopped 10 times and given 4 tickets. Something tells me race isn't the only factor.
you should've said racial profiling instead of just race
what is the other factor
Perhaps bad driving?

damn, triple ninja'd
also cant DUI mean literally any drug, not only alcohol? or is that DWI
Don't your cops have breath analysers?
I don't think American cops do, they rely on asking them questions and any obvious signs
I don't think American cops do, they rely on asking them questions and any obvious signs
I'm pretty sure they are fairly common.
also cant DUI mean literally any drug, not only alcohol? or is that DWI
afaik dwi is the subset of dui that applies to alcohol
I'm pretty sure they are fairly common.
I'm fairly certain they do as well. Also how is him being black relevant? It's not like they pulled over for being black, this isn't the 70's anymore.

They have PBT's - Portable Breath Tests. This man had that taken - shown 0's. This man also had a DRE - drug recognition expert - say he was fine.
Those two alone are enough to say hes a-ok
Doubtful...
Surprise, you're arrested!
What kind of name for a town is "Surprise"? It's like that town "Yonkers", I don't get why you would call a town that.
Then again, this is the town where they arrest someone for DUI when they get 0.000 on a breathalyzer.

I wouldn't know sorry, I've been used to watching COPS and "worlds dumbest people" on FOX8 when I was young to believe that
My older brother used to get stopped constantly for committing the crime of being a young, black man driving a fairly nice car.
My uncle used to get stopped and searched on an almost weekly basis when waiting to get picked up from work.
I think the colour of the guys skin is playing a bigger issue than some want to admit
He's been stopped 10 times and given 4 tickets. Something tells me race isn't the only factor.
You know those could be minor tickets, like speeding. Those tickets and stops could possibly be linked to racial profiling.
His late schedule is probably a large part of the equation as well. Every single time I've been stopped it's been after 8:00 PM.
This man also had a DRE - drug recognition expert - say he was fine.
is that where the pseudonym dr.dre comes from?
Someone REALLY fucked up if the PBT, DRE, and analysis says hes fine. Only guilty of being a shitty driver
The previous cops 'just doing their job' work with the same cop(s) who just wrongfully charged someone with a DUI to screw their license and livelihood.
Just sayin..

Just listen to my man Jay z explain it all, starts at about 0:55.
"He (the officer) walked up and he said 'I can tell you're driving [driving under the influence] by looking in your eyes,'"
That cop sounds like a total fucking idiot.

I really doubt he could have been that consistently racially profiled without their being other complaints against the department.
haha oh wow. I live in Surprise, and most of the cops are extremely bored. I wouldn't put it past them to do shit like this.
