most people have jobs/school/friends and don't have time to game for like 15 hours a day, so i guess ill be reverting to using idle servers. VALVe i loved you when you made Half Life... but this... is a disgrace... id rather pay a grand for a copy of vista then continue to support you guys now.

That's the point. You can't play often, thus they don't really want you to have a hat. Hats are for the people who play a lot, or have owned the game a long time.

They can't, without editing the terms of service I think. I mean and idle server could just be a regular dedicated server hosted by some Norwegian guy who doesn't have autokick on.

Reading through this, I got a bit annoyed. I can agree on your points in the, to a degree, yes it is Valve's fault. Now, I'm not sure on a few points, like the EULA containing external modification programs and the like, but here goes:
Valve released a new system to gain items and hats. Yes, it's a new, shitty system, but you have to remember something: Valve is doing this for the first time. It may have been extensively tested in their "labs", so to speak, but many times that comes from professionals that are paid to test video games. Many times, fans are a much more "reliable" source, because they think out of the box more often and tend to find flaws, bugs, and exploits.
The first analogy that comes to mind is new operating systems, mainly Windows. When Vista was first released, it was a steaming pile of shit that everyone hated and no one wanted. Years later, it's in Service Pack 2 and people are still hating on it for reasons unknown to me. I have Ultimate 32 bit and it runs fine. I like it just as much as I liked XP Professional SP2. And you know what? When XP came out all those years ago, it was a steaming pile of shit, too.
What I'm trying to say there is that, since this is the first time this is being implemented, give Valve some time and feedback. Let them have some breathing room to work with the new system, to fix it up. Random drops don't reward players that are doing well, no. But I bet you that Valve wanted a random drop system that would - all they need is time to be able to code the system to play in favor of players do well. Maybe not just the top players on teams, but the players that are doing better than they had previously, or better than their averages. But again, this would take time. You could either have no hats and no drop system, a horrible system for hats (ie achieving every achievement for the class [this would present problems with multiple hats now released]), or a broken system that would eventually be fixed.
All you needed to do was be patient and give Valve constructive feedback. They can, and probably would, listen to their fans and fix the system. So in a sense, you have brought this upon yourself. Especially if what is said about the EULA is correct. If the EULA says you are not to be using an external program that modifies or exploits the system, then you've fucked yourself over. You've cheated, and now you have to pay the consequences.
tl;dr You should have been patient and let Valve fix the system. You've reaped what you sowed, and should get over it.
I think I covered everything I wanted to in the nicest way possible.
It would have been better if they at least gave a heads up that they were going to do this and to remove these items at once.
