Well, even if the developer of this model made a new weapon, the developer would also have to supply new animations to go with it since sniper has no dual wielding pistol animations. Therefore, people would be purchasing the right to make use of the model and corresponding animations. If the animations don't work right with the new model, it still falls back to the whole goofed up animations thing.
Agreed, TF2 isn't quite so easy with plug and play, but it is possible. I can't imagine too many accommodations would be needed to actually implement---at the very least--testing of user animations.

If the animation doesn't work right, you don't go complaining to Valve, you edit your item to fit in the constrains of the things that work in-game.
A person submitting an animation will just have to deal with people possibly using his animations without credit in the future.

Also, that is true as far as animations go. And I'm not saying somebody should whien to Valve if their weapon doesn't conform to animations. But sometimes, some weapon ideas simply can't be used with existing animations. Dual wielding pistols just above is an example. How do you conform dual wielding to ANY of the snipers animations? Quite simply you don't. But, if the modder is willing to go out of his way to make animations from existing VALVE PROVIDED (therefore Valve-accessible and approved models)--then Valve shouldn't be so quick to turn them down.
That depends on the animation. For weapon hold animations, that is true. People would have to accept their animations may be associated with new weaponry in the future. However, for an animation such as the..say...The replay taunt...how is that going to be re-used by the modders? That's an action based animation that will be associated with that item and that's it.

I don't mind it on his back (I just assume it's magically glued to his grenade belt straps), but the side and front styles will only serve to clip like crazy with every future item added to Demoman's lower body (as it already clips with the lamp).
I think it should have been either/or. Either Demoman's hips, or Demoman's back. The limits of the equip region and style systems mean this clipping is unavoidable without making the item have harsh equipping restrictions. And harsher equipping restriction means less people using the item.
It's a fine model/texture but it shouldn't be a cosmetic item.
