I don't think so. The tats were updated months after the promo ended, long after the promo money was made. At this point old promos are just regular items.
Corporations make mistakes like this all the time. They bar people from doing something that in no way has to directly affect the marketing and may even bring in more customers for what is being changed or produced.
Example: Microsoft is barring youtube partners from making money off of videos that will cover Halo 4. They have the right to make that decision, but youtube serves as a huge advertisement with help from all the partners who are likely to cover the game. Its in their rights to make the decision, but they are deciding to get less profit by discouraging partners from posting videos, thus losing a ton of advertisement that they have to pay absolutely nothing for, and actually would get them more money in the long run if they weren't discouraging it like this.

Promo items are a usually "bonus" to pre-orders or other things, it is silly though.
I kinda wish they'd update my Kabuto, it feels so out of the TF2 style, even originally.
