Either way, it should be [U]large enough to be visible from some distance[/U] (as opposed to the Stach, which is a great idea, but far too small to see), preferable [U]non-paintable[/U] (other than black/after eight / brown / balaclavas, I can't think of any other colour it wouldn't look hideous or simply wrong... maybe the paint could only tint slightly the eyepatch?), and with [U]two styles[/U], left and right (maybe with political jokes on them, like "ignore the peasant rabble" for the eyepatch over the left).
If done successfully, this misc would be simple, fitting, and VERY versatile, as it does fit many character styles (pirates, nazis, steampunks, a trully Degroot demoman). Facial flexes would make it even better.
Also:
Heavy is bald, so it's really easy to fit the strap without clipping with anything
Medic's hair is quite short on the sides, so no clipping there too.
Spy could have the eyepatch under his mask.
Demoman could have the eyepatch like his current one.
Two quick examples - that spy is so awesome it's difficult do describe.

I remember seeing a item in the workshop that removed the grenades, flares and rockets from demo, pyro and soldier. Dont know if its downloadable though.

Well to be fair spinal columns are hardly restricted to Halloween. In fact, in their line of work, I would imagine they are relatively common, much like the disembodied limbs of enemy agents; whereas a brain in jar that somehow manages to retain control over it's host body, I would think, are much harder to come by.

I'm sorry but I respectfully disagree - if what you propose is true, thenwhat would be the justification for the Apparitions Aspect (essentially a semi-transluscent head like thing) being made unrestricted? Does the Pyro magically lose his head and remain a spirit for 365 days of the year?
I don't think we could possibly assign logic to Valve's choice on this because there doesn't seem to be one. Any possible explanation will only be met with a valid point countering it.

Yes, I am well aware what the Apparitions Aspect is and, personally, I think that should probably be restricted too, but this is of little importance since my point was more that 'the Bat Outta Hell made more sense as a year long item than the Plutonidome' rather than 'the Plutinodome should indeed remain restricted' which is admittedly more debatable.

I see your point, but I still disagree. Brain in a jar is exactly the kind of mad science Engineer or Medic would do in their downtime, while using a spinal column as a weapon when you've got perfectly good entrenching tools, bats, axes, etc is just downright silly and something I feel doesn't work outside the context of halloween.

About as silly as wasting time and resources creating a brain in a jar which could operate all the same functions as the average mercenary presumably.

No, my problem with the item is that it looks out of place and while I concede that I could imagine the Medic conducting such experiments (not so much Engineer, he seems to be far more interested in mechanics than organics and even ignoring this he is far too level-headed to suddenly think removing a teammates brain, putting it in a jar and then reestablishing a link to it's body is in even the slightest way a good idea) it still comes off as a bit too 'Frankenstein-ish' to be seen in everyday TF2. (IMO that is)

I disagree with a few of those items being called silly (EG: Solemn Vow is a heavy mass of solid stone, just as good for whacking people over the head with compared to a bonesaw, and something equally likely for a medical professional to have on their personage, and KGB are boxing gloves, which make sense as a weapon because they allow the wielder to punch harder without having to worry about damaging their own hands.), but you do have a point that TF2 does have lots of silly, year-round usable weapons already. I don't think we should try and increase that number though.

So, how about we just chalk this up to a difference of opinion and move on?
I really think the Plutonidome and the Brainframe being restricted is uneccesary, especially considering there are more out-there items that aren't.

The Solemn Vow is hardly the kinda thing you would take with you into a warzone though.
KGB have padding, making it less painful for both parties. That's why people wear boxing gloves in the first place - to protect both fighters. And again, not the kinda thing you would take into a warzone.
What's the problem with silly? I don't want TF2 to be serious. In TF2 I can beat people to death with a limp fish, that's not something many other games can offer.

For the Solemn Vow, well, I disagree. If you're going into a warzone, and your choice of melee weapons is a heavy statue or a bonesaw, they both seem reasonable to me.
The padding actually provides more protection to the user than the person being hit - since the introduction of boxing gloves, head injuries have actually gone up, because then boxers could punch their opponent in the face without having to worry about hurting their hands. They provide an advantage in combat, so it makes as much sense in a warzone as punching people with your bare hands.
