If it's supposed to resemble something copyrighted, it won't work. It's not even possible to change something by 10%, if it resembles something it resembles something. Team Captain and Deep Cover Operator may be references to popular franchises, but they're still items that fit the characters and aren't exclusive to their respective universes. A Darth Vader helmet is far too iconic and unique, and I'm assuming that device you're doing only appears in whatever game that is.

The Team Captain is clearly the former seeing as how it's based on an actual hat and the emblem isn't a skull.

I almost never do skins. I would post here my alternative paintable areas, which I've edited the alpha mask of some textures to have a different paintabillity. While the Team Captain is probably supposed to reference that hat, it's also different enough to not be copyright infringement. Besides, it's a red peaked cap with a winged crest. They weren't exactly uncommon in military settings around the world. It is possible that it wasn't made as a reference, but people took it that way because it looked similar.

I think Valve would have a better time shooting an email to Capcom, a fellow gaming company, about a somewhat-referential item for their own game, vs. trying to email Disney/George Lucas/etc., all corporations much larger than Capcom, for a more direct item reference/ripoff.

I would say that the more it copies from a game, the more obvious it is. So the Rocket Cap is so obvious because of the red 'R' on it. You would need to remove that and make it a normal flatcap in order for it to look normal. Take the stupid reference image I made for heinous' picture when we last argued about copyright in games and the TC, both posts supplied below. While it clearly looks like the legs if you take a close enough look, It also looks like the Spy is a huge perv and wants to show off his frog legs in the game. That and I left the Camouflage markings out of the image and I just could add hair to the picture. I don't know. But if I added, say, her hair and hat to the image, Then it would clearly look like Copyrighted. Is there another max quality config like chris' thats updated? When someone dies from a spy-cicle, it doesnt have the ice texture, but instead an uber-like looking texture. is this because im using directx 98 instead of 95? is there a difference?
